1. Conditional Use - Mango's (continued from March 23, 1999)

The Applicant, David Wallack (Mango's Tropical Cafe), Requests Conditional Use Approval in Order to Operate a Neighborhood Impact Establishment in excess of three-hundred (300) persons, at 900 Ocean Drive. (File #1387).

VOTED 5-2 (Mr. Lejeune and Mr. Turkel against) TO APPROVE AS PER STAFF RECOMMENDATION WITH ADDITIONAL CONDITIONS THAT THE SUBJECT ART GALLERY ROOMS BE MAINTAINED AS VIP ROOMS AND NOT CONVERTED TO DANCING ROOMS; AND THAT ALL OUTDOOR SPEAKERS BE REMOVED EXCEPT FOUR (4) 8 X12 INCH SPEAKERS PROJECTING BACKGROUND MUSIC MEETING THE NOISE ORDINANCE.

2. 40th Street - Rezoning

An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending the Official Zoning District Map, Referenced in Section 142-72 of the Code of the City of Miami Beach, Florida, by Changing the Zoning District Classification for the Area Generally Bounding the South Side of 40th Street Between Chase Avenue and Pinetree Drive [Lots 5 and 6, Block 50; Lots 10 through 15, Block 51; and Lots 11 and 12, Block 52; all of ORCHARD SUBDIVISION (8-116); together with Lots 8 through 10, Block 7 of FIRST ADDITION MID-GOLF SUBDIVISION (1-161)] from the Current Zoning District Classification RS-4 Single Family Residential, to the Proposed Zoning District Category RO Residential Office; Amending the Affected Portion of the City's Official Zoning District Map to Correspond with this Change as Adopted by the City Commission; Providing for Repealer, Severability and an Effective Date. 3. 40th Street - FLUM amendment

ITEMS 2 & 3: VOTED 7-0 TO RECOMMEND APPROVAL OF THE REZONING/FLUM AMENDMENT AS PER STAFF RECOMMENDATION, EXCEPT FOR THE PROPERTY AT 3767 CHASE AVENUE, WHICH SHOULD REMAIN SINGLE-FAMILY RESIDENTIAL. ALSO RECOMMENDED THAT THE RO RESIDENTIAL OFFICE DISTRICT SHOULD BE MODIFIED SO ALL USES OTHER THAN SINGLE-FAMILY RESIDENTIAL SHOULD REQUIRE CONDITIONAL USE APPROVAL.

4. Altos Del Mar - FLUM amendment

An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending the Future Land Use Map of the City of Miami Beach Comprehensive Plan for the Area Bounded by the Atlantic Ocean on the East, 77th Street on the North, Collins Avenue on the East, and 76th Street on the South, Excluding lot 6, block 10 of CORRECTED PLAT OF ALTOS DEL MAR NO. 1 [31-40], from the Current Future Land Use Category RS Single Family Residential, to the Proposed Future Land Use Category ROS Recreation and Open Space; Directing Transmittals of this Ordinance and All Applicable Documents to Affected Agencies; Providing for Repealer, Severability, Inclusion in the Comprehensive Plan and an Effective Date. (File #1390).

VOTED 6-1 (Mr. Turkel against) TO RECOMMEND AGAINST THE AMENDMENT AND TO RECOMMEND THAT THE PROPERTY REMAIN DESIGNATED SF SINGLE FAMILY RESIDENTIAL AS PER STAFF RECOMMENDATION.

5. St. Francis Hospital - Rezoning

The Applicant, 63rd Street Associates, Ltd. (Craig Robins), requests the rezoning of the Property at 250 W. 63rd Street (a/k/a St. Francis Hospital site) from the current zoning district classification HD Hospital District, to the proposed zoning district category RM-PRD2 Multiple Family, Planned Residential Development. (File #1391a); and,

6. St. Francis Hospital - FLUM amendment

The Applicant, 63rd Street Associates, Ltd. (Craig Robins), requests a change of the Future Land Use Map of the City of Miami Beach Comprehensive Plan, for the Property at 250 W. 63rd Street (a/k/a St. Francis Hospital site) from the current future land use category PF-RHO Public Facility (Religious, Hospital, Other), to the proposed future land use category RM-PRD Multi-Family, Planned Residential Development. 7. St. Francis Hospital - LDR amendment: RM-PRD2

The Applicant, 63rd Street Associates, Ltd. (Craig Robins), requests an Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending the Code of the City of Miami Beach, Florida; by Amending Chapter 142, Article II, Entitled "District Regulations", Amending Division 3, Subdivision III, Entitled "RM-PRD Multi Family, Planned Residential Development District", by Adding an RM-PRD2 Zoning District Classification; And, by Providing for Inclusion in the Code of the City of Miami Beach, Florida; Repealer, Severability and an Effective Date. (Craig Robins), requests an Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending the Code of the City of Miami Beach, Florida; by Amending Part II: Goals, Objectives and Policies of the City of Miami Beach Comprehensive Plan, by Modifying the Category Entitled "Low Density Planned Residential Category (RM-PRD) of Policy 1.2 of Objective 1: Land Development Regulations of the Future Land Use Element; And, Directing Transmittals of this Ordinance and All Applicable Documents to Affected Agencies; Providing for Repealer, Severability, Inclusion in the Comprehensive Plan and an Effective Date. ITEMS 5, 6, 7 & 8: VOTED 6-0 TO RECOMMEND APPROVAL OF THE REZONING/FLUM AND COMP PLAN TEXT AMENDMENTS AS PER STAFF RECOMMENDATION, AND APPROVAL OF A MODIFIED VERSION OF THE LDR AMENDMENT CREATING A NEW RM-PRD2 ZONING DISTRICT WITH CERTAIN HEIGHT, DENSITY AND FAR LIMITATIONS.

9. Bath Club - Rezoning

The Applicant, 5937 Collins, Inc. (R. Donahue Peebles), requests the rezoning of the Property at 5937 Collins Avenue (a/k/a the Bath Club) from the current zoning district classification RM-1 Residential Multi-Family Low Intensity, to the proposed zoning district category RM-2 Residential Multi-Family Medium Intensity. The Applicant, 5937 Collins, Inc. (R. Donahue Peebles), requests an Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending the Code of the City of Miami Beach, Florida; by Amending Chapter 142, Article II, Entitled "District Regulations", Amending Division 3, Subdivision IV, Entitled "RM-2 Residential Multi Family, Medium Intensity", by Modifying the Existing Maximum Height Restrictions and Maximum Number of Floors; And, by Providing for Inclusion in the Code of the City of Miami Beach, Florida; Repealer, Severability and an Effective Date. An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending the Code of the City of Miami Beach, Florida; by Amending Part II: Goals, Objectives and Policies of the City of Miami Beach Comprehensive Plan, by Modifying Policy 1.2 of Objective 1: Land Development Regulations of the Future Land Use Element By Adding the Language of the June 1997 Referendum; And, Directing Transmittals of this Ordinance and All Applicable Documents to Affected Agencies; Providing for Repealer, Severability, Inclusion in the Comprehensive Plan and an Effective Date. 13. Comp Plan text amendment: School Siting Requirements

An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending the City of Miami Beach Comprehensive Plan; by Modifying Part II: Goals, Objectives and Policies; by Modifying Objective 1: Land Development Regulations, of the Future Land Use Element by Adding Policy Regarding School Siting Requirements as Required by State Statute; by Modifying Objective 2: Comprehensive Plan Coordination, of the Intergovernmental Coordination Element by Adding Policy Regarding Requirements for Coordination with the Miami-Dade County School Board as Required by State Statute; by Modifying Part I: Data and Analysis, by Modifying Chapter I, Future Land Use Element by Adding Data and Analysis Pertaining to School Capacities, Enrollment and Projections; And, Directing Transmittals of this Ordinance and All Applicable Documents to Affected Agencies; Providing for Repealer, Severability, Inclusion in the Comprehensive Plan and an Effective Date. 14. Modification of GU Government Use Zoning District Classification

An Ordinance of the Mayor and City Commission of the City of Miami Beach, Florida, Amending Chapter 142, Entitled "Zoning Districts and Regulations", by Amending Article II, Entitled "District Regulations", by Amending Division 9, Entitled "GU Government Use District", by Amending Section 142-421, Entitled "Purpose", by Providing That Any Land or Air Rights Owned by or Leased to the City or Other Governmental Agency for an Initial Term No less than Twenty (20) Years Shall Automatically Convert to a GU Government Use District; and by Amending Section 142-425, Entitled "Development Regulations", by Amending Subsection (D) Thereof to Provide for an Additional Exception for Not-For-Profit Educational, Cultural, or Quasi Public Organizations; Providing for Severability; Codification; Repealer and an Effective Date. VOTED 7-0 TO RECOMMEND APPROVAL AS PER STAFF RECOMMENDATION, WITH ADDITIONAL RECOMMENDATION TO LIMIT PROVISION TO THE MIAMI CITY BALLET ONLY AND FOR A PERIOD OF UP TO THREE (3) YEARS ONLY.
