• Project Setting: The film must be ONLY set in Miami Beach and showcase the city's diverse locations beyond the typical beach scenes.
• Project Content: Projects should not be explicitly violent, sexually suggestive, or discriminatory in nature.
• Talent Considerations: When possible, please consider diversity and inclusion both in front of and behind the camera.
• Talent Rights: Talent should be in perpetuity and extend rights to VML and Miami Beach.
• Time Frame: The completed film must be delivered by April 30, 2025.
• Original Content: The project must be original work and not based on existing intellectual property unless all necessary rights have been secured.

• Creative Merit: Originality, storytelling quality, and artistic vision.
• Miami Beach Integration: Effective and creative use of Miami Beach locations, showcasing the city's diverse offerings beyond the typical beach scenes.
• Feasibility: Realistic budget and achievable production schedule
• Diversity and Inclusion: Demonstrated commitment to diversity and inclusion in all aspects of the project.
• Impact: Potential to generate positive publicity for Miami Beach and attract further film productions.

Successful applicants will be required to sign a production agreement outlining the terms and conditions of the funding, including reporting requirements, project deliverables, and ownership of intellectual property. With regard to intellectual property ownership, by submission of an application, the applicant acknowledges and agrees that substantially the following provisions will be included in the production agreement (the term “Producer” shall refer to successful applicants who accept the award):

Producer will deliver the Picture to the City by delivering to the Office of Marketing & Communications, no later than 6 PM EST on Monday, February 17, 2025, all the materials described in Schedule A attached and a complete list of all persons appearing in the Picture, together with a fully executed talent release in a form to be provided by the City for each such person. All references in this agreement to delivery of the Picture will mean delivery of those materials and that information in full compliance with this agreement. All references in this agreement to the Picture shall be deemed to include all footage made in connection with it, whether or not used in the finished version ("Outtakes") and behind-the-scenes footage (“BTS Footage”).

The City may edit, change, translate, dub and subtitle the Picture and do additional photography in connection with the Picture and shall have no obligation to employ Producer for such purposes. In addition, the City may combine the Picture (or portions thereof) with motion pictures produced by others.

The Picture, from the inception of production, including the Outtakes and BTS Footage, will be considered a work made for hire for the City; it will be deemed transferred to the City by this agreement, together with all rights in it, if it is to be determined not to be such a work. The Picture, and all duplications in whatever form, together with the performances embodied therein, shall be the sole property of the City in perpetuity, free from any claim whatsoever by Producer or any other person. The City shall have the exclusive right to copyright the Picture in its name as the owner and author thereof and to secure any and all renewals and extensions of such copyright throughout the world. Producer will execute and deliver to the City such instruments of transfer and other documents regarding the City’s rights in the Picture as the City may reasonably request to carry out the purposes of this agreement, and the City may sign such documents in your name and make appropriate disposition of them. The City shall have the unlimited right to exploit the Picture for all purposes by any means now or hereafter developed, and in any form whatsoever, under any trademarks, trade names and labels with no additional compensation payable to you. Producer shall not use the Picture or any portions of the Picture for any purpose whatsoever, including, without limitation, for inclusion in so-called "show reels" or other samples or resumes of Producer’s work, without the City’s prior written consent. The City shall have the same rights, under copyright or otherwise, in and to all materials (including but not limited to treatments, sets and backdrops) created by you in connection with production of the Picture. Producer will make such materials available to the City upon request. Producer will not use or authorize others to use those materials in connection with any project other than the Picture without the City’s prior written consent. Producer hereby waives, to the fullest extent permissible by law, all moral rights with respect to the Picture.
