Am 5. Februar verabschiedeten der B\u00fcrgermeister und die Stadtverordnetenversammlung die befristete Verordnung 2026-4793, die einen vereinfachten Weg f\u00fcr qualifizierte Restaurants, Bars und Indoor-Unterhaltungskonzepte in ausgew\u00e4hlten Gesch\u00e4ftsstra\u00dfen schafft.<\/p>\n

Unternehmen, die erlebnisorientierte Gastronomiekonzepte mit geeigneten Indoor-Unterhaltungsangeboten entwickeln, k\u00f6nnen ohne das vollst\u00e4ndige Genehmigungsverfahren fortfahren.\u00a0<\/p>\n

\u201cWir lockern und vereinfachen die Genehmigungsverfahren vor\u00fcbergehend, um Live-Unterhaltung und gehobene Gastronomie am Strand wieder anzusiedeln\u201d, sagte Alex J. Fernandez, Stadtrat von Miami Beach und Bef\u00fcrworter dieser \u00c4nderung. \u201cWenn man an die Bl\u00fctezeit von Miami Beach zur\u00fcckdenkt, erinnert man sich an beliebte Lokale wie das Van Dyke Cafe, das f\u00fcr seinen Live-Jazz ber\u00fchmt war. Ironischerweise d\u00fcrften solche Lokale, die so vermisst werden, nach den gerade ge\u00e4nderten Bestimmungen nicht mehr \u00f6ffnen. Indem wir die Genehmigungspflicht f\u00fcr bedingte Nutzungen aufheben, \u00f6ffnen wir die T\u00fcr f\u00fcr Live-Musik, hochwertige Restaurants und beleben unsere Haupteinkaufsstra\u00dfen neu.\u201d<\/p>\n

Was dies f\u00fcr unterhaltungsorientierte Konzepte bedeutet<\/b><\/p>\n

Die Verordnung sieht eine befristete Ausnahme von der \u00fcblichen Genehmigungspflicht f\u00fcr bestimmte Einrichtungen mit Auswirkungen auf das Wohnumfeld vor. Anstelle einer Anh\u00f6rung vor dem Planungsausschuss k\u00f6nnen qualifizierte Unternehmen die Genehmigung direkt vom Planungsamt erhalten.<\/p>\n

Dieser Wandel ist vor allem f\u00fcr Unternehmen mit Indoor-Programmen von Bedeutung.<\/p>\nDer tempor\u00e4re Weg bietet einem Unternehmen die M\u00f6glichkeit:
\n\u2022 als Restaurant oder Bar betrieben werden, sofern keine Unterhaltung angeboten wird; und\/oder
\n\u2022 als Restaurant-Supperclub betrieben werden, wenn Unterhaltung im Innenbereich angeboten wird.\n

Unternehmen, die kuratierte Live-Musik, auf Darbietungen basierende Gastronomie, DJ-Programme in Innenr\u00e4umen oder \u00e4hnliche Unterhaltungserlebnisse anbieten, k\u00f6nnen teilnahmeberechtigt sein, sofern alle anderen Kriterien erf\u00fcllt sind.<\/p>\n

Veranstaltungen im Freien sind im Rahmen dieser Initiative nicht gestattet. Dachterrassen und R\u00e4umlichkeiten im obersten Stockwerk sind ebenfalls ausgenommen.<\/p>\n

Hierbei geht es darum, Gewerbefl\u00e4chen im Erdgeschoss durch kontrollierte Indoor-Erlebnisse zu beleben, die die umliegenden Gesch\u00e4fte erg\u00e4nzen.\u00a0<\/p>\n

Wir reduzieren die B\u00fcrokratie und halten gleichzeitig hohe Standards aufrecht, damit verantwortungsbewusste Unternehmen schneller er\u00f6ffnen und unsere Gesch\u00e4ftsstra\u00dfen beleben k\u00f6nnen\u201d, teilte er mit.\u00a0Steven Meiner, B\u00fcrgermeister von Miami Beach.<\/b><\/p>\n

Wo dies zutrifft<\/b><\/p>\nDas vereinfachte Verfahren gilt nur innerhalb bestimmter Gewerbegebiete:
\n\u2022 Washington Avenue zwischen der 5th Street und der Lincoln Road
\n\u2022 Lincoln Road zwischen Collins Avenue und Alton Road
\n\u2022 Collins Avenue zwischen der 65. und 75. Stra\u00dfe
\n\u2022 71. Stra\u00dfe oder Normandy Drive zwischen Collins Avenue und Rue Notre Dame
\n\u2022 41. Stra\u00dfe zwischen Alton Road und Pine Tree Drive\n

Diese Hauptverkehrsadern sind zentral f\u00fcr das Einzelhandels- und Gastgewerbeangebot von Miami Beach. Die Vermietung leerstehender Ladenlokale hat einen Multiplikatoreffekt f\u00fcr angrenzende Mieter und Immobilieneigent\u00fcmer.<\/p>\n

Teilnahmeberechtigung und Betriebsparameter<\/b><\/p>\n

Voraussetzung ist, dass das Unternehmen in einem bestehenden Geb\u00e4ude mit einer vor dem 1. Januar 2025 ausgestellten Nutzungsgenehmigung t\u00e4tig ist. Die maximale Belegung ist auf 750 Personen begrenzt, wie vom Brandschutzbeauftragten festgelegt.<\/p>\n

Das Pr\u00fcfverfahren ist zwar vereinfacht, die Einhaltung der Vorschriften ist jedoch verpflichtend. Die zugeh\u00f6rige Gewerbesteuerquittung unterliegt weiterhin der Durchsetzung und kann bei Verst\u00f6\u00dfen widerrufen werden.<\/p>\n

Ein definiertes Fenster<\/b><\/p>\n

Diese Initiative l\u00e4uft am 31. Dezember 2026 automatisch aus, sofern sie nicht von der Stadtkommission verl\u00e4ngert wird.<\/p>\n

F\u00fcr Betreiber, die ein Restaurant-Erlebnis-Konzept in Betracht ziehen, ist der Zeitplan klar. Wenn das Konzept tragf\u00e4hig ist und der Standort die Voraussetzungen erf\u00fcllt, gibt es ein definiertes Zeitfenster, um im Rahmen eines besser planbaren Genehmigungsverfahrens weiterzumachen.<\/p>\n
