Puede ser utilizado por cualquier persona que desee presentar una queja alegando discriminaci\u00f3n por discapacidad en las pr\u00e1cticas y pol\u00edticas laborales, o en la prestaci\u00f3n de servicios, actividades, programas o beneficios por parte de la Ciudad de Miami Beach. La queja debe presentarse por escrito e incluir informaci\u00f3n sobre la discriminaci\u00f3n percibida, as\u00ed como el nombre, la direcci\u00f3n, el n\u00famero de tel\u00e9fono y la clasificaci\u00f3n del denunciante. Tambi\u00e9n debe incluir el lugar, la fecha y una descripci\u00f3n completa del problema. Se pondr\u00e1n a disposici\u00f3n, previa solicitud, medios alternativos para presentar quejas.<\/p>\n<p>La queja por escrito debe ser presentada por el reclamante o su designado lo antes posible, pero a m\u00e1s tardar 60 d\u00edas h\u00e1biles despu\u00e9s de la presunta infracci\u00f3n. Las quejas ser\u00e1n confidenciales en la medida de lo posible, pero no podr\u00e1n ocultarse a las personas encargadas de investigar y tomar medidas correctivas, si procede.<\/p>\n<p>El personal con autoridad deber\u00e1 esforzarse por no tomar ninguna medida disciplinaria adversa contra el denunciante ni ninguna otra acci\u00f3n que pueda ser percibida como represalia por ninguna de las partes. El Departamento de Recursos Humanos investigar\u00e1 y revisar\u00e1 las quejas, determinar\u00e1 si se ha producido un acto de discriminaci\u00f3n ilegal y recomendar\u00e1 la acci\u00f3n apropiada al Administrador Municipal o a la persona designada. Los gerentes y supervisores ser\u00e1n responsables de su pronta atenci\u00f3n y ejecuci\u00f3n de las acciones preventivas, correctivas y positivas necesarias.<\/p>\n<strong>Presente sus quejas sobre presuntas violaciones de la ADA a:<\/strong><br \/>\n<strong>Valeria Mej\u00eda, Gerente de ADA<\/strong><br \/>\nIngenier\u00eda de Obras P\u00fablicas<br \/>\n1700 Convention Center Drive<br \/>\nMiami Beach, FL 33139<br \/>\n305-673-7000 x22988\n<p>Dentro de los 15 d\u00edas h\u00e1biles siguientes a la recepci\u00f3n de la queja, la Coordinadora de la Ley para Estadounidenses con Discapacidades (ADA), Valeria Mej\u00eda, se comunicar\u00e1 con el denunciante para analizar la queja y las posibles soluciones. Dentro de los 15 d\u00edas h\u00e1biles posteriores a la reuni\u00f3n, la Sra. Mej\u00eda responder\u00e1 por escrito y, cuando corresponda, en un formato accesible para el denunciante, como letra grande, Braille o audio. La respuesta explicar\u00e1 la postura de la Ciudad de Miami Beach y ofrecer\u00e1 opciones para la resoluci\u00f3n sustantiva de la queja.<\/p>\n<p>Si la respuesta de la Sra. Mej\u00eda no resuelve satisfactoriamente el asunto, el reclamante o su designado podr\u00e1 apelar, dentro de los 15 d\u00edas h\u00e1biles siguientes a la recepci\u00f3n de la respuesta, al Director del Departamento de Recursos Humanos y al Subdirector.<\/p>\n<p>El Director de Recursos Humanos transmitir\u00e1 las conclusiones y recomendaciones al Director del Departamento correspondiente o, si la queja recae sobre el Director del Departamento, sobre el Subgerente Municipal. Si el asunto no se resuelve satisfactoriamente para todas las partes, el Director de Recursos Humanos, el Subdirector y el Director del Departamento correspondiente solicitar\u00e1n orientaci\u00f3n a los Subgerentes Municipales y al Gerente Municipal.<\/p>\n<p>Dentro de los 15 d\u00edas h\u00e1biles posteriores a la reuni\u00f3n, el Director de Recursos Humanos responder\u00e1 por escrito y, cuando corresponda, en un formato accesible para el reclamante, con una resoluci\u00f3n definitiva. El Coordinador de la ADA de la Ciudad de Miami Beach conservar\u00e1 todas las quejas escritas y los documentos relacionados durante al menos tres a\u00f1os.<\/p>\n<p>Si bien la Ciudad de Miami Beach se compromete a resolver las denuncias de discriminaci\u00f3n ilegal internamente, no es realista esperar que todos los denunciantes queden satisfechos con la investigaci\u00f3n y la resoluci\u00f3n del asunto.
