Esta pol\u00edtica se extiende a los procedimientos de solicitud, contrataci\u00f3n, ascensos, compensaci\u00f3n, beneficios, capacitaci\u00f3n y dem\u00e1s condiciones de empleo.<\/p>\n<p>La p\u00f3liza cubre a cualquier individuo calificado con una discapacidad que, con o sin una adaptaci\u00f3n razonable, pueda realizar las funciones esenciales del trabajo.<\/p>\n<p><b>Discapacidad definida<\/b><\/p>\n<p>Hay tres categor\u00edas de personas con discapacidad:<\/p>\n<ul>\n<li>Las personas con discapacidad son aquellas que tienen una discapacidad f\u00edsica o mental que limita considerablemente su capacidad para realizar una o m\u00e1s de las actividades principales de la vida. Estas actividades incluyen cuidar de s\u00ed mismas, realizar tareas manuales, caminar, ver, o\u00edr, hablar, aprender y trabajar.<\/li>\n<li>Personas que tienen antecedentes de una discapacidad f\u00edsica o mental que limita sustancialmente una o m\u00e1s de las principales actividades de la vida del individuo.<\/li>\n<li>Personas que se consideran que tienen una discapacidad, independientemente de que la tengan o no.<\/li>\n<\/ul>\n<b>Las discapacidades f\u00edsicas incluyen<\/b><br \/>\nTrastornos o afecciones fisiol\u00f3gicas, incluido el alcoholismo y la drogadicci\u00f3n, desfiguraci\u00f3n cosm\u00e9tica y p\u00e9rdida anat\u00f3mica de uno o m\u00e1s de los siguientes sistemas corporales: neurol\u00f3gico; musculoesquel\u00e9tico; \u00f3rganos sensoriales especiales; respiratorio, incluidos los \u00f3rganos del habla; cardiovascular; reproductivo; digestivo; genitourinario; hem\u00e1tico y linf\u00e1tico; cut\u00e1neo y endocrino.\n<b>Los impedimentos mentales incluyen<\/b><br \/>\nTrastornos mentales o psicol\u00f3gicos, como discapacidades intelectuales o del desarrollo, s\u00edndrome cerebral org\u00e1nico, enfermedades emocionales o mentales y otras discapacidades espec\u00edficas del aprendizaje.\n<b>Uso actual de drogas ilegales <\/b><br \/>\nEl &quot;consumo actual&quot; se refiere al consumo ilegal de sustancias controladas ocurrido lo suficientemente recientemente como para justificar una creencia razonable de que una persona consume drogas actualmente o que su consumo continuo constituye un problema real y persistente. Las personas que consumen drogas de forma actual e ilegal no se consideran discapacitadas y no est\u00e1n protegidas por esta pol\u00edtica.\n<b>Persona calificada con discapacidad <\/b><br \/>\nPara ser elegible, la persona con discapacidad debe ser capaz de desempe\u00f1ar las funciones esenciales del puesto en cuesti\u00f3n, con o sin adaptaciones razonables por parte de la Ciudad. No se considerar\u00e1 elegible a ninguna persona que represente una amenaza directa para la salud o la seguridad de los dem\u00e1s.\n<b>Adaptaciones razonables <\/b><br \/>\nLa Ciudad har\u00e1 adaptaciones razonables a las limitaciones f\u00edsicas o mentales conocidas de los solicitantes o empleados con discapacidades que de otro modo estar\u00edan calificados, a menos que hacerlo imponga una dificultad excesiva para el funcionamiento de la Ciudad.\n<p><b>PROCEDIMIENTOS<\/b><\/p>\n<b>Proceso de solicitud<\/b><br \/>\nLa Ciudad proporcionar\u00e1 adaptaciones razonables en todas las etapas del proceso de contrataci\u00f3n.<br \/>\nSe solicita a los solicitantes y empleados que informen al Departamento de Recursos Humanos lo antes posible si necesitan alguna adaptaci\u00f3n en el proceso de solicitud, prueba o entrevista.\n<b>Aptitud para el servicio <\/b><br \/>\nDe acuerdo con el Reglamento de Personal de la Ciudad, esta podr\u00e1 exigir una evaluaci\u00f3n m\u00e9dica de aptitud para el trabajo a fin de determinar si un empleado puede desempe\u00f1ar las funciones esenciales de su puesto. Esta evaluaci\u00f3n ser\u00e1 realizada por m\u00e9dicos especialistas que determinar\u00e1n si la condici\u00f3n del empleado es adecuada y qu\u00e9 adaptaciones razonables, si las hubiera, ser\u00edan necesarias de acuerdo con las funciones esenciales de la descripci\u00f3n del puesto actual.\n<b>Incapacidad permanente <\/b><br \/>\nUn empleado que ya no pueda desempe\u00f1ar las funciones esenciales de su puesto, con o sin adaptaciones razonables, podr\u00e1 ser considerado para otros puestos en la Ciudad para los que est\u00e9 cualificado. Si no existe dicho puesto, o si el empleado se niega a aceptarlo, y no es posible realizar adaptaciones razonables para retenerlo en su puesto actual ni en ning\u00fan otro, se considerar\u00e1 el despido. Esto no depender\u00eda de ning\u00fan recurso que el empleado tenga a trav\u00e9s de las prestaciones de compensaci\u00f3n laboral ni de las prestaciones de jubilaci\u00f3n por discapacidad.
