Como parte de sus continuos esfuerzos para gestionar la diversidad, de conformidad con las directrices sobre discriminaci\u00f3n sexual emitidas por la Comisi\u00f3n para la Igualdad de Oportunidades en el Empleo (EEOC), la Ciudad de Miami Beach apoya plenamente la legislaci\u00f3n que protege y salvaguarda los derechos y las oportunidades de todas las personas para buscar, obtener y mantener un empleo sin ser v\u00edctimas de acoso sexual. La pol\u00edtica de la Ciudad de Miami Beach es proporcionar un entorno libre de acoso sexual.\n<b>Concientizaci\u00f3n sobre el acoso sexual <\/b><br \/>\nEl acoso sexual es una violaci\u00f3n del T\u00edtulo VII de la Ley de Derechos Civiles de 1964. Como tal, cada empleado de la Ciudad de Miami Beach, hombre o mujer, como condici\u00f3n de empleo y de acuerdo con las pol\u00edticas de la Ciudad, se compromete a defender y afirmar dicha Pol\u00edtica de Acoso que la Ciudad ha adoptado y al comprometerse a ello acepta: no hacer insinuaciones sexuales no deseadas o solicitudes de favores sexuales u otra conducta verbal o f\u00edsica de naturaleza sexual como condici\u00f3n del empleo de ning\u00fan empleado; no tomar decisiones de empleo basadas en la sumisi\u00f3n o el rechazo de dicha conducta; y no crear un ambiente de trabajo intimidante, hostil u ofensivo mediante dicha conducta.\n<b>Definiciones<\/b><br \/>\nEl acoso sexual se refiere a un comportamiento que es personalmente ofensivo, no respeta los derechos de los dem\u00e1s, baja la moral y, por lo tanto, interfiere con la eficacia laboral. El acoso sexual puede ser manifiesto o sutil. Por definici\u00f3n, el acoso sexual es insultante y degradante para quien lo recibe y no puede tolerarse en el lugar de trabajo. Una v\u00edctima de acoso sexual no tiene que ser la persona acosada; incluye a cualquier persona afectada por la conducta ofensiva. El acoso sexual es una conducta no deseada de naturaleza sexual y puede consistir en insinuaciones sexuales, solicitudes de favores sexuales y otras conductas verbales o f\u00edsicas. La conducta puede constituir acoso sexual cuando afecta expl\u00edcita o impl\u00edcitamente el empleo de una persona, interfiere irrazonablemente con el desempe\u00f1o laboral de una persona o crea un ambiente de trabajo intimidante, hostil u ofensivo. El supervisor de la v\u00edctima, un agente del empleador, un supervisor en otra \u00e1rea, un compa\u00f1ero de trabajo o una persona que no sea empleada pueden ser acosadores sexuales.\n<p>En cada caso, la v\u00edctima decide si su comportamiento es bienvenido o indeseable. Lo que cuenta es el impacto del comportamiento en la v\u00edctima, no la intenci\u00f3n del acosador. Todas las quejas presentadas ante la Divisi\u00f3n de Relaciones Laborales y Empleados del Departamento de Recursos Humanos se toman en serio. Cada caso se revisa para determinar su idoneidad y se investiga seg\u00fan sus m\u00e9ritos. El sexo del denunciante no influye en la denuncia. Con los avances tecnol\u00f3gicos, el acoso sexual ahora incluye <em>\u201cAcoso textual\u201d<\/em> que es \u201cenviar mensajes de texto\u201d ofensivos u otros mensajes inapropiados, y <em>\u201cSexting\u201d<\/em> que implica el env\u00edo de mensajes sexualmente expl\u00edcitos, y tambi\u00e9n incluye, pero no se limita a, fotograf\u00edas u otro material pornogr\u00e1fico y bromas.<\/p>\n<p>El acoso sexual puede adoptar diferentes formas, entre ellas:<\/p>\n<ul>\n<li><em>Verbal:<\/em>\u00a0 Insinuaciones, comentarios sugerentes, bromas de car\u00e1cter sexual, proposiciones sexuales, amenazas.<\/li>\n<li><em>No verbal:\u00a0<\/em>Objetos o im\u00e1genes sexualmente sugerentes, comentarios gr\u00e1ficos, sonidos sugerentes o insultantes, miradas lascivas, silbidos, gestos obscenos.<\/li>\n<li><em>F\u00edsico:<\/em>\u00a0\u00a0 Contacto f\u00edsico no deseado, incluyendo tocamientos, pellizcos, roces del cuerpo y agresi\u00f3n sexual.<\/li>\n<\/ul>\n<p>Cada empleado de la gerencia, incluyendo a los supervisores directos, es responsable de mantener un ambiente laboral libre de acoso sexual. Esta responsabilidad incluye, entre otras cosas, recordar a los empleados bajo su supervisi\u00f3n la pol\u00edtica de la Ciudad contra el acoso sexual. Cuando un gerente o supervisor tenga conocimiento de un incidente de acoso sexual, es su responsabilidad informar a Lana Hern\u00e1ndez, de la Divisi\u00f3n de Relaciones Laborales y Empleados del Departamento de Recursos Humanos, si la persona afectada desea que se denuncie su situaci\u00f3n o no desea buscar medidas correctivas. Puede comunicarse con la Sra. Hern\u00e1ndez llamando al 305.673.7524.<\/p>\nDada la gravedad de este tipo de discriminaci\u00f3n, la Ciudad reconoce que las acusaciones inv\u00e1lidas, infundadas o falsas de acoso sexual pueden tener efectos graves y perjudiciales para personas inocentes. Si la denuncia...<br \/>\nSi se determina que una denuncia falsa es falsa y constituye una tergiversaci\u00f3n deliberada de los hechos, realizada con mala intenci\u00f3n, la parte que la presente enfrentar\u00e1 medidas disciplinarias. Tambi\u00e9n se tomar\u00e1n las medidas disciplinarias correspondientes contra cualquier empleado que infrinja esta pol\u00edtica.\n<p><b>PROCEDIMIENTOS<\/b><\/p>\n<b>C\u00f3mo presentar una denuncia por acoso sexual<br \/>\n<\/b>Cualquier empleado que crea que ha sido objeto de acoso sexual debe informar el incidente inmediatamente a su supervisor, director de departamento o a la Sra. Hern\u00e1ndez.\n<p>Si una queja es contra un Director de Departamento, deber\u00e1 presentarse directamente ante la Sra. Hern\u00e1ndez. Las quejas se investigar\u00e1n de forma confidencial y oportuna. La informaci\u00f3n relativa a una queja no se divulgar\u00e1 a terceros ni a ninguna persona de la Ciudad que no tenga necesidad de conocerla. El prop\u00f3sito de esta disposici\u00f3n es proteger la confidencialidad de los empleados que presenten una queja, alentarlos a denunciar cualquier incidente de acoso sexual y proteger la reputaci\u00f3n de cualquier empleado acusado injustamente de acoso sexual.<\/p>\n<p>La investigaci\u00f3n de las quejas generalmente incluye la consulta con las partes involucradas y cualquier testigo, ya sea identificado o aparente. Se garantizar\u00e1 a los empleados un trato imparcial y justo. Todos los empleados estar\u00e1n protegidos contra coerci\u00f3n, intimidaci\u00f3n, represalias, interferencia o discriminaci\u00f3n por presentar una queja o colaborar en una investigaci\u00f3n.
