La ley exige que informe el accidente o su conocimiento de una lesi\u00f3n o enfermedad laboral dentro de los 30 d\u00edas siguientes a su conocimiento.<br \/>\n\u2022 Para su atenci\u00f3n inicial, utilice el centro de tratamiento autorizado, Fast Care, a menos que la lesi\u00f3n\/enfermedad sea grave, en cuyo caso dir\u00edjase a la sala de emergencias m\u00e1s cercana.<br \/>\n\u2022 Su supervisor informar\u00e1 la lesi\u00f3n\/enfermedad a CorVel Corporation a trav\u00e9s del Sistema de gesti\u00f3n de reclamaciones de CareMC.<br \/>\nSu supervisor seguir\u00e1 recibiendo actualizaciones del Examinador de Reclamaciones de CorVel sobre el estado de su reincorporaci\u00f3n al trabajo, las restricciones, las citas y la autorizaci\u00f3n cuando un empleado pueda reincorporarse al trabajo. Estos formularios pueden formar parte de un paquete que puede incluir algunos o todos los siguientes documentos:<br \/>\nUna copia de su informe de accidente o \u201cPrimer informe de lesi\u00f3n o enfermedad\u201d, que debe leer para asegurarse de que sea correcto;<br \/>\nUna declaraci\u00f3n de fraude, que debe leer, firmar y devolver lo antes posible, o los beneficios pueden ser retenidos temporalmente hasta que lo haga;<br \/>\nUna autorizaci\u00f3n de registros m\u00e9dicos para que usted los firme y los devuelva; y<br \/>\nFormularios de reembolso de kilometraje m\u00e9dico que debe completar despu\u00e9s de recibir tratamiento m\u00e9dico y enviar a su examinador de reclamaciones de CorVel para su reembolso. Si no recibe una llamada ni el paquete informativo de CorVel Corporation, puede llamar a la l\u00ednea directa de WC para obtener asistencia al 1.800.342.1741.<br \/>\n\u2022 Proporcione al m\u00e9dico una descripci\u00f3n completa del accidente o de c\u00f3mo result\u00f3 herido.<br \/>\n\u2022 Si le dan el alta para trabajar pero no puede regresar a su mismo trabajo, debe obtener instrucciones del m\u00e9dico sobre qu\u00e9 trabajo puede y no puede realizar.<br \/>\n\u2022 Cumplir con todas las citas con su m\u00e9dico o sus beneficios podr\u00edan ser suspendidos.<br \/>\nHable con su supervisor tan pronto como salga de la consulta. Expl\u00edquele qu\u00e9 tareas le indic\u00f3 el m\u00e9dico que puede y no puede realizar.<br \/>\n\u2022 Preg\u00fantele a su empleador si tiene alg\u00fan trabajo al que pueda regresar que no requiera que haga cosas que el m\u00e9dico le dijo que a\u00fan no puede hacer.<br \/>\n\u2022 En caso afirmativo, pregunte cu\u00e1ndo debe presentarse a trabajar.<br \/>\n\u2022 En caso contrario, aseg\u00farese de que su empleador tenga una forma de comunicarse con usted si surge alg\u00fan trabajo adecuado disponible.<br \/>\n\u2022 Si es ingresado en un hospital, llame o pida a alguien que llame a su supervisor para explicarle lo sucedido y d\u00f3nde se encuentra.<br \/>\n\u2022 Comun\u00edquese con su examinador de reclamos de CorVel y h\u00e1gale saber lo que dijo el m\u00e9dico sobre sus lesiones y su estado laboral.<br \/>\n\u2022 Debe continuar en contacto con su supervisor y su examinador de reclamaciones de CorVel durante todo su tratamiento y recuperaci\u00f3n.\n<b>DEBERES DEL EMPLEADOR<\/b><br \/>\n\u2022 Comun\u00edquese con CorVel Corporation de inmediato, a trav\u00e9s del Sistema de gesti\u00f3n de reclamos de CareMC para informar una lesi\u00f3n o enfermedad relacionada con el trabajo.<br \/>\n\u2022 Mant\u00e9ngase en contacto con su empleado y el Examinador de Reclamaciones de CorVel hasta que el trabajador lesionado se reincorpore al trabajo. Si el empleado recibe el alta para trabajar con restricciones...<br \/>\n\u2022 Obtenga la lista de restricciones del m\u00e9dico del trabajador lesionado o del examinador de reclamos de CorVel, y<br \/>\n\u2022 Reunirse con el trabajador lesionado para ver si hay trabajo disponible que pueda realizar.<br \/>\n\u2022 Si hay trabajo restringido disponible:<br \/>\nHable con el trabajador lesionado:<br \/>\nHora y fecha de inicio, y<br \/>\nInforme el trabajo restringido al examinador de reclamaciones de CorVel.<br \/>\n\u2022 Informar al examinador de reclamaciones de CorVel:<br \/>\nCuando est\u00e1 previsto que el trabajador lesionado regrese a un trabajo restringido.<br \/>\nSi el trabajador lesionado no puede, debido a restricciones, continuar trabajando, o<br \/>\nSi ya no puede darle trabajo restringido, o<br \/>\nSi el m\u00e9dico le da el alta para trabajar regularmente\n<strong>Infracciones penales de compensaci\u00f3n laboral de empleados<\/strong><br \/>\nLas siguientes son violaciones criminales del art. 440.105, FS, que constituyen un delito grave de primer, segundo o tercer grado dependiendo del valor monetario del fraude seg\u00fan lo dispuesto en el art. 775.082, art. 775.083 o art. 775.084, FS:<br \/>\n\u2022 Presentar una reclamaci\u00f3n falsa por lesiones ocurridas en el trabajo o exagerar las lesiones.<br \/>\n\u2022 Un empleado lesionado o cualquier parte que haga un reclamo por una lesi\u00f3n o enfermedad en el trabajo deber\u00e1 proporcionar su firma personal que certifique que ha revisado, comprende y reconoce la siguiente declaraci\u00f3n: \u201cCualquier persona que, a sabiendas y con la intenci\u00f3n de lesionar, defraudar o enga\u00f1ar a cualquier empleador o empleado, compa\u00f1\u00eda de seguros o programa de autoasegurado, presente una declaraci\u00f3n de reclamo que contenga informaci\u00f3n falsa o enga\u00f1osa comete fraude de seguros, punible seg\u00fan lo dispuesto en la s. 817.234\u201d.<br \/>\n\u2022 Si el trabajador o la parte lesionada se niega a firmar el documento, los beneficios o pagos se suspender\u00e1n hasta que se obtenga dicha firma.\n<strong>C\u00f3mo obtener m\u00e1s informaci\u00f3n y ayuda con su reclamo<\/strong><br \/>\nDivisi\u00f3n de Compensaci\u00f3n de Trabajadores, Oficina de Asistencia al Empleado y Defensor del Pueblo:<br \/>\n\u2022 La Oficina del Defensor del Pueblo y Asistencia al Empleado (EAO) lo ayudar\u00e1 sin costo con las preguntas o inquietudes que pueda tener sobre su reclamo de compensaci\u00f3n laboral.<br \/>\n\u2022 EAO trabaja en su nombre para resolver problemas con su reclamo de compensaci\u00f3n laboral.<br \/>\n\u2022 Las oficinas de EAO est\u00e1n ubicadas en todo el estado para ayudarlo.<br \/>\nSitio web: http:\/\/www.myfloridacfo.com\/Division\/WC\/Employee\/default.htm<br \/>\nhttp:\/\/www.myfloridacfo.com\/Division\/WC\/Employee\/eao_offices.htm<br \/>\nTel\u00e9fono: 1.800.342.1741\n<em>La Divisi\u00f3n de Compensaci\u00f3n de Trabajadores<\/em><br \/>\nSitio web: www.myfloridacfo.com\/Division\/WC\/<br \/>\nPara m\u00e1s informaci\u00f3n, haga clic en &quot;Informaci\u00f3n y preguntas frecuentes&quot; en el lado izquierdo de la p\u00e1gina principal de la Divisi\u00f3n.
