Elle peut \u00eatre utilis\u00e9e par toute personne souhaitant d\u00e9poser une plainte pour discrimination fond\u00e9e sur le handicap dans les pratiques et politiques d&#039;emploi, ou dans la prestation de services, d&#039;activit\u00e9s, de programmes ou d&#039;avantages sociaux par la Ville de Miami Beach. La plainte doit \u00eatre formul\u00e9e par \u00e9crit et contenir des informations sur la discrimination per\u00e7ue, ainsi que le nom, l&#039;adresse, le num\u00e9ro de t\u00e9l\u00e9phone et la classification du plaignant. Elle doit \u00e9galement inclure le lieu, la date et une description d\u00e9taill\u00e9e du probl\u00e8me. D&#039;autres moyens de d\u00e9p\u00f4t de plainte seront mis \u00e0 disposition sur demande.<\/p>\n<p>La plainte \u00e9crite doit \u00eatre d\u00e9pos\u00e9e par le plaignant ou son repr\u00e9sentant dans les meilleurs d\u00e9lais, au plus tard 60 jours ouvrables apr\u00e8s la violation all\u00e9gu\u00e9e. Les plaintes doivent \u00eatre confidentielles dans la mesure du possible, mais ne peuvent \u00eatre dissimul\u00e9es aux personnes en mesure d&#039;enqu\u00eater et de prendre des mesures correctives, le cas \u00e9ch\u00e9ant.<\/p>\n<p>Le personnel en position d&#039;autorit\u00e9 doit tout mettre en \u0153uvre pour ne prendre aucune mesure disciplinaire \u00e0 l&#039;encontre du plaignant ni aucune autre action pouvant \u00eatre per\u00e7ue comme une mesure de repr\u00e9sailles. Le service des ressources humaines enqu\u00eate sur les plaintes, d\u00e9termine si un acte de discrimination ill\u00e9gale a \u00e9t\u00e9 commis et recommande les mesures appropri\u00e9es au directeur g\u00e9n\u00e9ral de la ville ou \u00e0 son repr\u00e9sentant. Dans les 15 jours ouvrables suivant cette rencontre, Mme Mejia r\u00e9pondra par \u00e9crit et, le cas \u00e9ch\u00e9ant, dans un format accessible au plaignant, tel que gros caract\u00e8res, braille ou enregistrement audio. La r\u00e9ponse exposera la position de la Ville de Miami Beach et proposera des options pour un r\u00e8glement concret de la plainte.<\/p>\n<p>Si la r\u00e9ponse de Mme Mejia ne r\u00e9sout pas le probl\u00e8me de mani\u00e8re satisfaisante, le plaignant ou son repr\u00e9sentant peut faire appel, dans les 15 jours ouvrables suivant la r\u00e9ception de la r\u00e9ponse, aupr\u00e8s du directeur du d\u00e9partement des ressources humaines et du directeur adjoint.<\/p>\n<p>Le directeur des ressources humaines transmet ses conclusions et recommandations au directeur du service concern\u00e9, ou au directeur g\u00e9n\u00e9ral adjoint si ce dernier est vis\u00e9 par la plainte. Si le diff\u00e9rend ne peut \u00eatre r\u00e9gl\u00e9 \u00e0 la satisfaction de toutes les parties, le directeur des ressources humaines, le directeur adjoint et le directeur du service concern\u00e9 consultent les directeurs g\u00e9n\u00e9raux adjoints et le directeur g\u00e9n\u00e9ral.<\/p>\n<p>Dans les 15 jours ouvrables suivant la r\u00e9union, le directeur des ressources humaines r\u00e9pondra par \u00e9crit et, le cas \u00e9ch\u00e9ant, dans un format accessible au plaignant, avec une r\u00e9solution d\u00e9finitive. Toutes les plaintes \u00e9crites et les documents connexes seront conserv\u00e9s par le coordinateur ADA de la ville de Miami Beach pendant au moins trois ans.<\/p>\n<p>Bien que la Ville de Miami Beach s&#039;engage \u00e0 traiter les plaintes pour discrimination ill\u00e9gale en interne, il est illusoire de s&#039;attendre \u00e0 ce que chaque plaignant soit satisfait de l&#039;enqu\u00eate et de la r\u00e9solution de son affaire.
