Dans le cadre de ses efforts continus en mati\u00e8re de gestion de la diversit\u00e9 et conform\u00e9ment aux directives sur la discrimination sexuelle \u00e9mises par la Commission pour l&#039;\u00e9galit\u00e9 des chances en mati\u00e8re d&#039;emploi, la Ville de Miami Beach soutient pleinement la l\u00e9gislation visant \u00e0 prot\u00e9ger et \u00e0 garantir les droits et les chances de chacun de chercher, d&#039;obtenir et d&#039;occuper un emploi sans \u00eatre victime de harc\u00e8lement sexuel. La Ville de Miami Beach a pour politique de fournir un environnement exempt de harc\u00e8lement sexuel.\n<b>Sensibilisation au harc\u00e8lement sexuel <\/b><br \/>\nLe harc\u00e8lement sexuel est une violation du Titre VII de la loi sur les droits civils de 1964. En tant que tel, chaque employ\u00e9 de la ville de Miami Beach, homme ou femme, comme condition d&#039;emploi, et conform\u00e9ment aux politiques de la ville, s&#039;engage \u00e0 respecter et \u00e0 affirmer la politique de harc\u00e8lement adopt\u00e9e par la ville et, ce faisant, s&#039;engage \u00e0 : ne pas faire d&#039;avances sexuelles non d\u00e9sir\u00e9es ou de demandes de faveurs sexuelles ou d&#039;autres comportements verbaux ou physiques de nature sexuelle comme condition d&#039;emploi d&#039;un employ\u00e9 ; ne pas prendre de d\u00e9cisions d&#039;emploi fond\u00e9es sur la soumission ou le rejet d&#039;un tel comportement ; et ne pas cr\u00e9er un environnement de travail intimidant, hostile ou offensant par un tel comportement.\n<b>D\u00e9finitions<\/b><br \/>\nLe harc\u00e8lement sexuel d\u00e9signe un comportement offensant, contraire aux droits d&#039;autrui, d\u00e9moralisant et, par cons\u00e9quent, nuisant \u00e0 l&#039;efficacit\u00e9 au travail. Il peut \u00eatre manifeste ou subtil. Par d\u00e9finition, le harc\u00e8lement sexuel est insultant et d\u00e9gradant pour la personne qui en est victime et ne peut \u00eatre tol\u00e9r\u00e9 sur le lieu de travail. La victime de harc\u00e8lement sexuel n&#039;est pas n\u00e9cessairement la personne harcel\u00e9e\u00a0; cela inclut toute personne affect\u00e9e par le comportement offensant. Le harc\u00e8lement sexuel est un comportement importun \u00e0 caract\u00e8re sexuel et peut prendre la forme d&#039;avances sexuelles, de demandes de faveurs sexuelles et d&#039;autres comportements verbaux ou physiques. Un comportement peut constituer du harc\u00e8lement sexuel lorsqu&#039;il affecte explicitement ou implicitement l&#039;emploi d&#039;une personne, entrave d\u00e9raisonnablement sa performance au travail ou cr\u00e9e un environnement de travail intimidant, hostile ou offensant. Le superviseur de la victime, un agent de l&#039;employeur, un superviseur d&#039;un autre service, un coll\u00e8gue ou une personne non salari\u00e9e peut \u00eatre un harceleur sexuel.\n<p>Dans chaque cas, la victime d\u00e9cide si un comportement est bienvenu ou non. C&#039;est l&#039;impact du comportement sur la victime qui compte, et non l&#039;intention du harceleur. Toutes les plaintes d\u00e9pos\u00e9es aupr\u00e8s de la Division des relations de travail et des employ\u00e9s de la Direction des ressources humaines sont prises au s\u00e9rieux. Chaque cas est examin\u00e9 pour en v\u00e9rifier la pertinence et fait l&#039;objet d&#039;une enqu\u00eate au fond. Le sexe du plaignant n&#039;a aucune incidence sur la plainte. Avec les progr\u00e8s technologiques, le harc\u00e8lement sexuel inclut d\u00e9sormais <em>\u00ab Harc\u00e8lement textuel \u00bb<\/em> qui est un \u00ab texto \u00bb offensant ou d\u2019autres messages inappropri\u00e9s, et <em>\u00ab Sexting \u00bb<\/em> qui implique l&#039;envoi de messages sexuellement explicites, et comprend \u00e9galement, mais sans s&#039;y limiter, des photographies ou d&#039;autres contenus pornographiques et des blagues.<\/p>\n<p>Le harc\u00e8lement sexuel peut prendre diff\u00e9rentes formes, notamment :<\/p>\n<ul>\n<li><em>Verbal:<\/em>\u00a0 Insinuations, commentaires suggestifs, blagues \u00e0 caract\u00e8re sexuel, propositions sexuelles, menaces.<\/li>\n<li><em>Non verbal:\u00a0<\/em>Objets ou images \u00e0 caract\u00e8re sexuel, commentaires explicites, sons suggestifs ou insultants, regards lubriques, sifflements, gestes obsc\u00e8nes.<\/li>\n<li><em>Physique:<\/em>\u00a0\u00a0 Contact physique non d\u00e9sir\u00e9, y compris toucher, pincer, effleurer le corps, agression sexuelle.<\/li>\n<\/ul>\n<p>Chaque cadre, y compris les superviseurs de premier niveau, est tenu de maintenir un environnement de travail exempt de harc\u00e8lement sexuel. Cette responsabilit\u00e9 comprend, entre autres, le rappel aux employ\u00e9s sous sa supervision de la politique de la Ville contre le harc\u00e8lement sexuel. Lorsqu&#039;un gestionnaire ou un superviseur est inform\u00e9 d&#039;un incident de harc\u00e8lement sexuel, il lui incombe d&#039;informer Lana Hernandez, de la Division du travail et des relations avec les employ\u00e9s du Service des ressources humaines, si la personne concern\u00e9e souhaite que sa situation soit signal\u00e9e ou non. Vous pouvez joindre Mme Hernandez au 305.673.7524.<\/p>\nCompte tenu de la gravit\u00e9 de ce type de discrimination, la Ville reconna\u00eet que des accusations de harc\u00e8lement sexuel invalides, infond\u00e9es ou fausses peuvent avoir des cons\u00e9quences graves et n\u00e9fastes sur des personnes innocentes. Si la plainte est d\u00e9pos\u00e9e,<br \/>\nSi une fausse d\u00e9claration est jug\u00e9e fausse et constitue une fausse d\u00e9claration d\u00e9lib\u00e9r\u00e9e, formul\u00e9e avec une intention malveillante, la partie d\u00e9posant la fausse plainte s&#039;expose \u00e0 des sanctions disciplinaires. Des sanctions disciplinaires appropri\u00e9es seront \u00e9galement prises \u00e0 l&#039;encontre de tout employ\u00e9 qui enfreint cette politique.\n<p><b>PROC\u00c9DURES<\/b><\/p>\n<b>D\u00e9poser une plainte pour harc\u00e8lement sexuel<br \/>\n<\/b>Tout employ\u00e9 qui croit avoir \u00e9t\u00e9 victime de harc\u00e8lement sexuel doit signaler imm\u00e9diatement l\u2019incident \u00e0 son superviseur, au directeur de service ou \u00e0 Mme Hernandez.\n<p>Si une plainte vise un directeur de service, elle doit \u00eatre d\u00e9pos\u00e9e directement aupr\u00e8s de Mme Hernandez. Les plaintes feront l&#039;objet d&#039;une enqu\u00eate confidentielle et rapide. Les informations relatives \u00e0 une plainte ne seront divulgu\u00e9es \u00e0 aucun tiers ni \u00e0 quiconque au sein de la Ville n&#039;ayant pas besoin d&#039;en \u00eatre inform\u00e9. Cette disposition vise \u00e0 prot\u00e9ger la confidentialit\u00e9 des informations concernant un employ\u00e9 qui d\u00e9pose une plainte, \u00e0 encourager les employ\u00e9s \u00e0 signaler tout incident de harc\u00e8lement sexuel et \u00e0 prot\u00e9ger la r\u00e9putation de tout employ\u00e9 accus\u00e9 \u00e0 tort de harc\u00e8lement sexuel.<\/p>\n<p>L&#039;enqu\u00eate sur les plaintes comprend g\u00e9n\u00e9ralement des entretiens avec les parties concern\u00e9es et tout t\u00e9moin nomm\u00e9 ou apparent. Les employ\u00e9s doivent b\u00e9n\u00e9ficier d&#039;un traitement impartial et \u00e9quitable. Tous les employ\u00e9s doivent \u00eatre prot\u00e9g\u00e9s contre toute coercition, intimidation, repr\u00e9sailles, ing\u00e9rence ou discrimination pour avoir d\u00e9pos\u00e9 une plainte ou particip\u00e9 \u00e0 une enqu\u00eate. Si l&#039;enqu\u00eate r\u00e9v\u00e8le le bien-fond\u00e9 de la plainte, une intervention rapide et des mesures disciplinaires visant \u00e0 mettre fin imm\u00e9diatement au harc\u00e8lement et
