Ce cr\u00e9dit d&#039;imp\u00f4t offre une r\u00e9duction d&#039;imp\u00f4t sur le revenu \u00e9quivalente \u00e0 celle due. Le cr\u00e9dit d&#039;imp\u00f4t pour la r\u00e9habilitation 20% \u00e9quivaut \u00e0 20% du montant d\u00e9pens\u00e9 pour la r\u00e9habilitation d&#039;un b\u00e2timent historique certifi\u00e9. L&#039;objectif du cr\u00e9dit pour la r\u00e9habilitation est de remettre le b\u00e2timent en \u00e9tat afin qu&#039;il soit fonctionnel et r\u00e9ponde aux besoins actuels en mati\u00e8re de logement, de commerces, de commerces ou d&#039;industrie.<\/p>\n<p>Tous les \u00e9l\u00e9ments d&#039;un projet de r\u00e9habilitation doivent \u00eatre conformes aux normes de r\u00e9habilitation du secr\u00e9taire \u00e0 l&#039;Int\u00e9rieur. Ils doivent \u00e9galement satisfaire aux exigences fiscales de base du Code des imp\u00f4ts. Le cr\u00e9dit d&#039;imp\u00f4t doit \u00eatre demand\u00e9 sur le formulaire IRS appropri\u00e9 pour l&#039;ann\u00e9e d&#039;imposition au cours de laquelle le b\u00e2timent r\u00e9habilit\u00e9 est mis en service.<\/p>\n<p>Les servitudes de pr\u00e9servation permettent de d\u00e9duire de l&#039;imp\u00f4t f\u00e9d\u00e9ral sur le revenu les dons de bienfaisance sous forme de participations partielles dans des propri\u00e9t\u00e9s historiques. Une servitude de pr\u00e9servation est un accord juridique volontaire entre un propri\u00e9taire foncier (le conc\u00e9dant) et un organisme gouvernemental ou de pr\u00e9servation (le b\u00e9n\u00e9ficiaire). Elle prot\u00e8ge \u00e0 perp\u00e9tuit\u00e9 une ressource historique, arch\u00e9ologique ou culturelle importante au b\u00e9n\u00e9fice des g\u00e9n\u00e9rations futures.<\/p>\n<p>La servitude peut \u00eatre propre \u00e0 chaque propri\u00e9t\u00e9 et englober de nombreux \u00e9l\u00e9ments. Les \u00e9l\u00e9ments prot\u00e9g\u00e9s peuvent inclure la fa\u00e7ade, l&#039;int\u00e9rieur, le terrain, les vues panoramiques, les droits a\u00e9riens, etc. La servitude de fa\u00e7ade est le type de donation le plus pratique et le plus courant. Les termes de l&#039;accord sont convenus d&#039;un commun accord entre le propri\u00e9taire et l&#039;organisme titulaire de la servitude.<\/p>\n<p>Une servitude permet au donateur de conserver la propri\u00e9t\u00e9 et l&#039;usage priv\u00e9s d&#039;un bien et, sous r\u00e9serve de certains crit\u00e8res, de b\u00e9n\u00e9ficier d&#039;une d\u00e9duction fiscale f\u00e9d\u00e9rale \u00e9quivalente \u00e0 la valeur des droits donn\u00e9s. Des conditions de conservation permanente doivent \u00eatre convenues et respect\u00e9es pour que le propri\u00e9taire puisse b\u00e9n\u00e9ficier de cette d\u00e9duction fiscale. De plus, le public doit avoir un acc\u00e8s visuel au bien donn\u00e9. La servitude lie le propri\u00e9taire qui l&#039;accorde ainsi que tous les propri\u00e9taires ult\u00e9rieurs. Le propri\u00e9taire peut vendre ou l\u00e9guer le bien \u00e0 qui il le souhaite.<\/p>\n<p>Des informations d\u00e9taill\u00e9es sur le cr\u00e9dit d&#039;imp\u00f4t 20% ou les servitudes de pr\u00e9servation peuvent \u00eatre obtenues aupr\u00e8s du National Park Service et de l&#039;Internal Revenue Service, <a href=\"https:\/\/www.nps.gov\/index.htm\"><strong>www.nps.gov<\/strong><\/a> \/ 202.354.2055; ou le responsable de la pr\u00e9servation historique de l&#039;\u00c9tat, 850.245.6300.<\/p>\n<p><strong><a href=\"http:\/\/www.miamidade.gov\/planning\/historic-preservation.asp\">Incitations \u00e0 la pr\u00e9servation du patrimoine historique local<\/a><\/strong><\/p>\n<p>En plus de la zone d&#039;entreprise, les am\u00e9liorations apport\u00e9es aux propri\u00e9t\u00e9s historiques peuvent \u00eatre admissibles \u00e0 l&#039;incitation \u00e0 la pr\u00e9servation historique du comt\u00e9 de Miami-Dade, qui offre une r\u00e9duction de 10 ans des taxes fonci\u00e8res sur les am\u00e9liorations.<\/p>\n<p>Le comt\u00e9 de Miami Dade offre une exon\u00e9ration de taxe fonci\u00e8re ad valorem, qui exon\u00e8re 100% de la valeur imposable de toutes les am\u00e9liorations admissibles apport\u00e9es aux propri\u00e9t\u00e9s historiques pendant une p\u00e9riode de 10 ans. Cette exon\u00e9ration s&#039;applique uniquement aux taxes fonci\u00e8res du comt\u00e9, et non aux taxes fonci\u00e8res municipales. La l\u00e9gislation du comt\u00e9 de Miami Dade fonctionne en \u00ab gelant \u00bb la valeur imposable au taux d&#039;imposition avant les am\u00e9liorations. Autrement dit, la plus-value ajout\u00e9e par les am\u00e9liorations autoris\u00e9es n&#039;est pas ajout\u00e9e \u00e0 l&#039;\u00e9valuation fonci\u00e8re.<\/p>\n<p>Pour b\u00e9n\u00e9ficier de cet avantage, le propri\u00e9taire doit d\u00e9poser une demande aupr\u00e8s du Conseil de pr\u00e9servation historique de Miami Beach, qui la transmet, accompagn\u00e9e de sa recommandation, au Bureau de pr\u00e9servation historique du comt\u00e9 de Miami-Dade pour traitement ult\u00e9rieur. Une fois la demande approuv\u00e9e, le propri\u00e9taire s&#039;engage aupr\u00e8s de la Commission du comt\u00e9 \u00e0 assurer l&#039;entretien et la protection de son bien pour une p\u00e9riode de dix ans \u00e0 compter du 1er janvier, apr\u00e8s la fin des travaux. De nombreux biens historiques de South Beach b\u00e9n\u00e9ficient de cet avantage. Cette m\u00e9thode permet d&#039;\u00e9valuer le bien en fonction de son utilisation r\u00e9elle plut\u00f4t que de son utilisation optimale, ce qui peut avoir un impact sur la r\u00e9duction des imp\u00f4ts fonciers. Pour \u00eatre \u00e9ligible, le bien doit \u00eatre officiellement class\u00e9 comme historique, soit par arr\u00eat\u00e9 local, soit par inscription au Registre national des lieux historiques. Il doit \u00e9galement \u00eatre de nature commerciale (les immeubles d&#039;habitation ne sont pas inclus) et \u00eatre ouvert au public au moins 40 heures par semaine pendant 45 semaines par an, soit l&#039;\u00e9quivalent de 1\u00a0800 heures par an. Cet avantage s&#039;applique uniquement \u00e0 la part de la taxe fonci\u00e8re du comt\u00e9 de Miami-Dade.<\/p>\n<p>Pour b\u00e9n\u00e9ficier de cet avantage, les propri\u00e9taires de biens admissibles doivent d\u00e9poser une demande aupr\u00e8s du service d&#039;\u00e9valuation fonci\u00e8re du comt\u00e9 de Miami-Dade avant le 1er mars de chaque ann\u00e9e.
