Para isso, a cidade adotou decretos que visam proteger a qualidade de vida residencial, preservando as caracter\u00edsticas \u00fanicas da nossa vibrante cidade.<\/p>\n<h2>\n\t\t\tAbaixo est\u00e3o breves descri\u00e7\u00f5es das principais categorias de viola\u00e7\u00f5es emitidas pelo Departamento de Conformidade do C\u00f3digo:\t<\/h2>\n\t\t\t\t\t<a href=\"#\"  id=\"fl-accordion--label-0\" tabindex=\"0\" aria-controls=\"fl-accordion--panel-0\">C\u00f3digo da Cidade<\/a>\n\t\t\t\t\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion--icon-0\"  tabindex=\"0\"><i title=\"Expandir\">Expandir<\/i><\/a>\n\t\t\t\t\t<p>O C\u00f3digo Municipal regulamenta atividades que incluem, entre outras, empresas que n\u00e3o obt\u00eam o Recibo de Imposto Comercial, n\u00e3o entregam\/pagam o Imposto de Resort, n\u00e3o conduzem neg\u00f3cios em propriedade p\u00fablica, caf\u00e9s ao ar livre (condi\u00e7\u00f5es para alvar\u00e1s); quest\u00f5es e atividades ambientais (isopor, vidro de praia, tartarugas marinhas e lixo); bloqueio de direito de passagem, placas em propriedade p\u00fablica e eventos especiais (n\u00e3o obten\u00e7\u00e3o de alvar\u00e1 ou viola\u00e7\u00e3o das condi\u00e7\u00f5es do alvar\u00e1). O Departamento de Conformidade com o C\u00f3digo tomar\u00e1 as medidas necess\u00e1rias para garantir que moradores, empresas e visitantes cumpram as normas do C\u00f3digo Municipal.<\/p>\n\t\t\t\t\t<a href=\"#\"  id=\"fl-accordion--label-1\" tabindex=\"0\" aria-controls=\"fl-accordion--panel-1\">C\u00f3digo Mar\u00edtimo<\/a>\n\t\t\t\t\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion--icon-1\"  tabindex=\"0\"><i title=\"Expandir\">Expandir<\/i><\/a>\n\t\t\t\t\t<p>Os C\u00f3digos Mar\u00edtimos abordam especificamente quest\u00f5es envolvendo embarca\u00e7\u00f5es e estruturas na \u00e1gua. Isso inclui a manuten\u00e7\u00e3o de docas, estacas, p\u00ederes, pared\u00f5es e barcos fixados a essas estruturas. Os C\u00f3digos Mar\u00edtimos tamb\u00e9m abordam embarca\u00e7\u00f5es afundadas, lixo e detritos em cursos d&#039;\u00e1gua, e embarca\u00e7\u00f5es abandonadas.<\/p>\n\t\t\t\t\t<a href=\"#\"  id=\"fl-accordion--label-2\" tabindex=\"0\" aria-controls=\"fl-accordion--panel-2\">Barulho<\/a>\n\t\t\t\t\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion--icon-2\"  tabindex=\"0\"><i title=\"Expandir\">Expandir<\/i><\/a>\n\t\t\t\t\t<p>A Lei do Ru\u00eddo foi elaborada para proteger a qualidade de vida residencial, preservando as caracter\u00edsticas \u00fanicas da nossa vibrante cidade. Ru\u00eddos excessivamente altos, desnecess\u00e1rios ou incomuns resultar\u00e3o em viola\u00e7\u00e3o \u00e0 lei e, possivelmente, em multa se n\u00e3o forem remediados prontamente.<\/p>\n\t\t\t\t\t<a href=\"#\"  id=\"fl-accordion--label-3\" tabindex=\"0\" aria-controls=\"fl-accordion--panel-3\">Gest\u00e3o de Propriedades<\/a>\n\t\t\t\t\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion--icon-3\"  tabindex=\"0\"><i title=\"Expandir\">Expandir<\/i><\/a>\n\t\t\t\t\t<p>O C\u00f3digo da Cidade de Miami Beach exige que os im\u00f3veis sejam mantidos adequadamente. Isso significa que os im\u00f3veis devem ser pintados, mantidos livres de entulho, grama alta e ervas daninhas, sem janelas quebradas ou faltando e obedecendo aos Padr\u00f5es M\u00ednimos de Habita\u00e7\u00e3o. Todo propriet\u00e1rio \u00e9 obrigado a manter seu im\u00f3vel livre de lixo e entulho e bem conservado, para que n\u00e3o represente um problema de seguran\u00e7a para a comunidade. O Departamento de Conformidade com o C\u00f3digo tomar\u00e1 todas as medidas necess\u00e1rias para garantir que o im\u00f3vel atenda aos regulamentos de manuten\u00e7\u00e3o.<\/p>\n\t\t\t\t\t<a href=\"#\"  id=\"fl-accordion--label-4\" tabindex=\"0\" aria-controls=\"fl-accordion--panel-4\">Saneamento<\/a>\n\t\t\t\t\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion--icon-4\"  tabindex=\"0\"><i title=\"Expandir\">Expandir<\/i><\/a>\n\t\t\t\t\t<p>O Departamento de Conformidade com o C\u00f3digo \u00e9 o bra\u00e7o respons\u00e1vel pela fiscaliza\u00e7\u00e3o do Cap\u00edtulo 90 \u2013 Res\u00edduos S\u00f3lidos do C\u00f3digo de Leis e Portarias da Cidade. Essas viola\u00e7\u00f5es incluem, entre outras, reciclagem, empresas de coleta de lixo que n\u00e3o removem todo o lixo, permitem que lixo e entulho transbordem em um cont\u00eainer, lata ou ca\u00e7amba, cont\u00eaineres de lixo sem tampa, coleta de lixo fora do hor\u00e1rio especificado, descarte ilegal de lixo, entulho ou res\u00edduos industriais e volumosos, materiais de risco biol\u00f3gico ou cria\u00e7\u00e3o de risco \u00e0 sa\u00fade ou inc\u00f4modo para a comunidade.<\/p>\n\t\t\t\t\t<a href=\"#\"  id=\"fl-accordion--label-5\" tabindex=\"0\" aria-controls=\"fl-accordion--panel-5\">Zoneamento<\/a>\n\t\t\t\t\t\t\t\t\t\t\t<a href=\"#\" id=\"fl-accordion--icon-5\"  tabindex=\"0\"><i title=\"Expandir\">Expandir<\/i><\/a>\n\t\t\t\t\t<p>As viola\u00e7\u00f5es de zoneamento referem-se \u00e0s viola\u00e7\u00f5es dos Regulamentos de Uso do Solo do C\u00f3digo Municipal. Os c\u00f3digos de zoneamento s\u00e3o interpretados pelo Diretor de Planejamento e Zoneamento e aplicados pelo Departamento de Conformidade com os C\u00f3digos. Cada parte da cidade possui uma designa\u00e7\u00e3o de zoneamento (como residencial unifamiliar, residencial multifamiliar, comercial, etc.). Os Regulamentos de Uso do Solo identificam os tipos de atividades e constru\u00e7\u00f5es permitidas em cada zona. Um uso n\u00e3o permitido deve ser descontinuado permanentemente ou at\u00e9 que uma varia\u00e7\u00e3o seja solicitada ao Conselho de Ajustes de Zoneamento. Uma solicita\u00e7\u00e3o por escrito deve ser enviada antes da data de cumprimento em nosso escrit\u00f3rio, localizado na 1680 Meridian Avenue, Su\u00edte 602, Miami Beach, FL 33139, durante o hor\u00e1rio comercial normal (8h30 \u00e0s 17h). Entre em contato com o Departamento de Conformidade com o C\u00f3digo pelo telefone 305.673.7555 em caso de d\u00favidas.<strong><a href=\"\/wp-content\/uploads\/2017\/09\/Extension-Request-Form-11-27-2017.pdf\">Formul\u00e1rio de solicita\u00e7\u00e3o de extens\u00e3o <\/a><\/strong><\/p><\/li><li>\t\t\n\t\t\t\t<img decoding=\"async\" src=\"https:\/\/www.miamibeachfl.gov\/wp-content\/uploads\/bb-plugin\/cache\/familyplanning-circle.jpg\" alt=\"Couple with documents in front of their computer\" title=\"planejamento familiar\" itemprop=\"image\"\/>\n\t\t<h3>Lidar com viola\u00e7\u00f5es com uma multa imediata<\/h3><p>Algumas viola\u00e7\u00f5es do C\u00f3digo Municipal acarretam multa imediata. A multa \u00e9 identificada no aviso de viola\u00e7\u00e3o. A multa deve ser paga dentro do prazo especificado ou a viola\u00e7\u00e3o pode ser apelada ao Magistrado Especial no Cart\u00f3rio do Secret\u00e1rio Municipal. Pagar a multa ou n\u00e3o recorrer da viola\u00e7\u00e3o dentro do prazo permitido \u00e9 considerado admiss\u00e3o de culpa e qualquer viola\u00e7\u00e3o subsequente ser\u00e1 considerada reincid\u00eancia. Viola\u00e7\u00e3o com multa aplicada. O infrator pode pagar a multa ou recorrer dentro do prazo especificado.<strong>O n\u00e3o pagamento da multa ou a n\u00e3o apresenta\u00e7\u00e3o de recurso resultar\u00e1 em uma Ordem Final exigindo o valor total devido.<\/strong><\/p><\/li><li>\t\t\n\t\t\t\t<img decoding=\"async\" src=\"https:\/\/www.miamibeachfl.gov\/wp-content\/uploads\/bb-plugin\/cache\/PublicRecords-PersonComputer-circle.jpg\" alt=\"Public Record Searching\" title=\"Registros P\u00fablicos-PessoaComputador\" itemprop=\"image\"\/>\n\t\t<h3>Lidar com viola\u00e7\u00f5es sem multa imediata<\/h3><p>O C\u00f3digo emite um Aviso de Viola\u00e7\u00e3o, com uma data de cumprimento. O infrator pode corrigir a viola\u00e7\u00e3o at\u00e9 a data de cumprimento ou solicitar uma extens\u00e3o (observe que nem todas as viola\u00e7\u00f5es se qualificam para uma extens\u00e3o). O caso ser\u00e1 encerrado quando o cumprimento for alcan\u00e7ado. A n\u00e3o corre\u00e7\u00e3o da viola\u00e7\u00e3o at\u00e9 a data de cumprimento resultar\u00e1 no encaminhamento do caso ao Magistrado Especial para uma audi\u00eancia. Se o infrator for considerado culpado pelo Magistrado Especial, uma nova data de cumprimento poder\u00e1 ser definida e uma multa di\u00e1ria ser\u00e1 imposta por descumprimento. Se a viola\u00e7\u00e3o for corrigida antes da data de cumprimento, o caso ser\u00e1 encerrado. A n\u00e3o corre\u00e7\u00e3o da viola\u00e7\u00e3o at\u00e9 a data de cumprimento resultar\u00e1 no ac\u00famulo de uma multa di\u00e1ria, conforme determinado pelo Magistrado Especial. A multa se tornar\u00e1 um \u00f4nus sobre a propriedade.<strong>Uma vez que haja uma viola\u00e7\u00e3o e\/ou o prazo para corrigir um aviso de cortesia tenha expirado, ocorre o seguinte:<\/strong>Uma data para a audi\u00eancia do Magistrado Especial \u00e9 definida. O Oficial de Conformidade com o C\u00f3digo realizar\u00e1 uma nova inspe\u00e7\u00e3o pouco antes da audi\u00eancia para determinar se a \u00e1rea de preocupa\u00e7\u00e3o ainda existe. Se a \u00e1rea de preocupa\u00e7\u00e3o for corrigida antes da data de conformidade, uma declara\u00e7\u00e3o juramentada de conformidade ser\u00e1 preenchida pelo Oficial de Conformidade com o C\u00f3digo e encaminhada ao Magistrado Especial. Se a \u00e1rea de preocupa\u00e7\u00e3o ainda existir, a audi\u00eancia prosseguir\u00e1. Se o Magistrado Especial concluir que n\u00e3o h\u00e1 culpa, o caso ser\u00e1 arquivado. Se o Magistrado Especial concluir que h\u00e1 culpa, uma nova data de conformidade ser\u00e1 definida e uma multa di\u00e1ria ser\u00e1 aplicada se a \u00e1rea de preocupa\u00e7\u00e3o n\u00e3o for corrigida at\u00e9 a data de conformidade. A multa pode ser de at\u00e9 $1.000 por dia para a primeira infra\u00e7\u00e3o e $5.000 por dia para uma reincid\u00eancia. (Uma viola\u00e7\u00e3o julgada \u00e9 considerada reincid\u00eancia se ocorrer novamente dentro de cinco anos). Se a \u00e1rea problem\u00e1tica for corrigida antes da nova data de conformidade definida pelo Magistrado Especial, uma declara\u00e7\u00e3o de conformidade ser\u00e1 preenchida pelo Oficial de Conformidade do C\u00f3digo e encaminhada ao Magistrado Especial. Tanto o caso do Magistrado Especial quanto o caso de Conformidade do C\u00f3digo ser\u00e3o encerrados. Se a infra\u00e7\u00e3o n\u00e3o for corrigida at\u00e9 a data de conformidade definida pelo Magistrado Especial, uma declara\u00e7\u00e3o de n\u00e3o conformidade ser\u00e1 preenchida pelo oficial e encaminhada ao Magistrado Especial, e a multa di\u00e1ria come\u00e7ar\u00e1 a ser acumulada. O caso permanecer\u00e1 aberto enquanto a viola\u00e7\u00e3o existir e houver multas pendentes, mesmo que as viola\u00e7\u00f5es sejam corrigidas.
