Ele pode ser utilizado por qualquer pessoa que deseje registrar uma queixa alegando discrimina\u00e7\u00e3o com base na defici\u00eancia em pr\u00e1ticas e pol\u00edticas de emprego, ou na presta\u00e7\u00e3o de servi\u00e7os, atividades, programas ou benef\u00edcios pela Cidade de Miami Beach. A reclama\u00e7\u00e3o deve ser feita por escrito e conter informa\u00e7\u00f5es sobre a discrimina\u00e7\u00e3o percebida, bem como o nome, endere\u00e7o, n\u00famero de telefone e classifica\u00e7\u00e3o do reclamante. Deve tamb\u00e9m incluir o local, a data e uma descri\u00e7\u00e3o completa do problema. Mediante solicita\u00e7\u00e3o, meios alternativos para registrar reclama\u00e7\u00f5es ser\u00e3o disponibilizados.<\/p>\n<p>A reclama\u00e7\u00e3o por escrito deve ser apresentada pelo reclamante ou seu representante o mais breve poss\u00edvel, mas no m\u00e1ximo em at\u00e9 60 dias \u00fateis ap\u00f3s a suposta viola\u00e7\u00e3o. As reclama\u00e7\u00f5es devem ser confidenciais, na medida do poss\u00edvel, mas n\u00e3o podem ser ocultadas das pessoas que est\u00e3o em posi\u00e7\u00e3o de investigar e tomar medidas corretivas, se apropriado.<\/p>\n<p>Os funcion\u00e1rios em posi\u00e7\u00e3o de autoridade devem envidar todos os esfor\u00e7os para n\u00e3o tomar qualquer medida disciplinar adversa contra o reclamante, nem qualquer outra medida que possa ser percebida como retalia\u00e7\u00e3o por qualquer das partes. O Departamento de Recursos Humanos deve investigar e analisar as reclama\u00e7\u00f5es, determinar se ocorreu um ato de discrimina\u00e7\u00e3o ilegal e recomendar uma a\u00e7\u00e3o apropriada ao Administrador Municipal ou pessoa designada. Os gerentes e supervisores ser\u00e3o responsabilizados pela sua pronta aten\u00e7\u00e3o e execu\u00e7\u00e3o das a\u00e7\u00f5es preventivas, corretivas e afirmativas necess\u00e1rias.<\/p>\n<strong>Envie den\u00fancias sobre supostas viola\u00e7\u00f5es da ADA para:<\/strong><br \/>\n<strong>Valeria Mejia, Gerente da ADA<\/strong><br \/>\nEngenharia de Obras P\u00fablicas<br \/>\n1700 Convention Center Drive<br \/>\nMiami Beach, FL 33139<br \/>\n305-673-7000 ramal 22988\n<p>Dentro de 15 dias \u00fateis ap\u00f3s o recebimento da reclama\u00e7\u00e3o, a Coordenadora da ADA, Valeria Mejia, entrar\u00e1 em contato com o reclamante para discutir a reclama\u00e7\u00e3o e poss\u00edveis solu\u00e7\u00f5es. Dentro de 15 dias \u00fateis ap\u00f3s a reuni\u00e3o, a Sra. Mejia responder\u00e1 por escrito e, quando apropriado, em um formato acess\u00edvel ao reclamante, como letras grandes, Braille ou \u00e1udio. A resposta explicar\u00e1 a posi\u00e7\u00e3o da cidade de Miami Beach e oferecer\u00e1 op\u00e7\u00f5es para a resolu\u00e7\u00e3o substancial da reclama\u00e7\u00e3o.<\/p>\n<p>Se a resposta da Sra. Mejia n\u00e3o resolver o problema satisfatoriamente, o reclamante ou seu representante poder\u00e1 apelar, dentro de 15 dias \u00fateis ap\u00f3s o recebimento da resposta, ao Diretor do Departamento de Recursos Humanos e ao Diretor Assistente.<\/p>\n<p>O Diretor de Recursos Humanos dever\u00e1 transmitir as conclus\u00f5es e recomenda\u00e7\u00f5es ao Diretor do Departamento competente ou ao Subdiretor Municipal, caso o Diretor do Departamento seja o alvo da reclama\u00e7\u00e3o. Se a quest\u00e3o n\u00e3o puder ser resolvida de forma satisfat\u00f3ria para todas as partes, o Diretor de Recursos Humanos, o Subdiretor e o Diretor do Departamento competente dever\u00e3o buscar orienta\u00e7\u00e3o junto aos Subdiretores Municipais e ao Prefeito.<\/p>\n<p>No prazo de 15 dias \u00fateis ap\u00f3s a reuni\u00e3o, o Diretor de Recursos Humanos responder\u00e1 por escrito e, quando apropriado, em um formato acess\u00edvel ao reclamante, com uma resolu\u00e7\u00e3o final para a reclama\u00e7\u00e3o. Todas as reclama\u00e7\u00f5es por escrito e documentos relacionados ser\u00e3o mantidos pelo Coordenador de ADA da Cidade de Miami Beach por pelo menos tr\u00eas anos.<\/p>\n<p>Embora a Prefeitura de Miami Beach esteja comprometida em resolver den\u00fancias de discrimina\u00e7\u00e3o ilegal internamente, \u00e9 irrealista esperar que todos os reclamantes fiquem satisfeitos com a investiga\u00e7\u00e3o e a resolu\u00e7\u00e3o do caso. Portanto, todos os reclamantes nesses casos devem ser informados sobre seu direito de registrar uma queixa junto a uma ag\u00eancia externa.<\/p>\n<p>Under no circumstances shall the complaint and investigative file become a part of an employee&#8217;s personnel folder, the official personnel file or any file maintained by the department, division or supervisor.
