Esta pol\u00edtica se estende aos procedimentos de candidatura, contrata\u00e7\u00e3o, promo\u00e7\u00e3o, remunera\u00e7\u00e3o, benef\u00edcios, treinamento e todos os demais termos de emprego.<\/p>\n<p>A ap\u00f3lice cobre qualquer indiv\u00edduo qualificado com defici\u00eancia que, com ou sem acomoda\u00e7\u00e3o razo\u00e1vel, possa desempenhar as fun\u00e7\u00f5es essenciais do trabalho.<\/p>\n<p><b>Defini\u00e7\u00e3o de defici\u00eancia<\/b><\/p>\n<p>Existem tr\u00eas categorias de indiv\u00edduos com defici\u00eancia:<\/p>\n<ul>\n<li>Pessoas com defici\u00eancia s\u00e3o aquelas que apresentam uma defici\u00eancia f\u00edsica ou mental que limita substancialmente sua capacidade de se envolver em uma ou mais das principais atividades da vida. As principais atividades da vida incluem cuidar de si mesmo, realizar tarefas manuais, caminhar, enxergar, ouvir, falar, aprender e trabalhar.<\/li>\n<li>Indiv\u00edduos que t\u00eam um hist\u00f3rico de defici\u00eancia f\u00edsica ou mental que limita substancialmente uma ou mais das principais atividades da vida do indiv\u00edduo.<\/li>\n<li>Indiv\u00edduos que s\u00e3o considerados portadores de defici\u00eancia, independentemente de terem ou n\u00e3o a defici\u00eancia.<\/li>\n<\/ul>\n<b>Defici\u00eancias f\u00edsicas incluem<\/b><br \/>\nDist\u00farbios ou condi\u00e7\u00f5es fisiol\u00f3gicas, incluindo alcoolismo e depend\u00eancia de drogas, desfigura\u00e7\u00e3o est\u00e9tica e perda anat\u00f4mica de um ou mais dos seguintes sistemas corporais: neurol\u00f3gico; musculoesquel\u00e9tico; \u00f3rg\u00e3os sensoriais especiais; respirat\u00f3rio, incluindo \u00f3rg\u00e3os da fala; cardiovascular; reprodutivo; digestivo; geniturin\u00e1rio; hem\u00e1tico e linf\u00e1tico; cut\u00e2neo e end\u00f3crino.\n<b>Defici\u00eancias mentais incluem<\/b><br \/>\nTranstornos mentais ou psicol\u00f3gicos, como defici\u00eancias intelectuais ou de desenvolvimento, s\u00edndrome cerebral org\u00e2nica, doen\u00e7as emocionais ou mentais e outras dificuldades espec\u00edficas de aprendizagem.\n<b>Uso atual de drogas ilegais <\/b><br \/>\n\u201cUso atual\u201d \u00e9 o uso ilegal de subst\u00e2ncias controladas que ocorreu recentemente o suficiente para fundamentar uma cren\u00e7a razo\u00e1vel de que o uso de drogas por uma pessoa \u00e9 atual ou que o uso cont\u00ednuo \u00e9 um problema real e cont\u00ednuo. Indiv\u00edduos que se envolvem no uso atual e ilegal de drogas n\u00e3o s\u00e3o considerados deficientes e n\u00e3o est\u00e3o protegidos por esta pol\u00edtica.\n<b>Pessoa qualificada com defici\u00eancia <\/b><br \/>\nPara ser qualificado, o indiv\u00edduo com defici\u00eancia deve ser capaz de desempenhar as fun\u00e7\u00f5es essenciais do cargo em quest\u00e3o, com ou sem adapta\u00e7\u00f5es razo\u00e1veis por parte da Prefeitura. Uma pessoa que represente uma amea\u00e7a direta \u00e0 sa\u00fade ou seguran\u00e7a de terceiros n\u00e3o se qualificar\u00e1.\n<b>Acomoda\u00e7\u00f5es razo\u00e1veis <\/b><br \/>\nA Cidade far\u00e1 acomoda\u00e7\u00f5es razo\u00e1veis \u00e0s limita\u00e7\u00f5es f\u00edsicas ou mentais conhecidas de candidatos qualificados ou funcion\u00e1rios com defici\u00eancias, a menos que isso imponha uma dificuldade indevida \u00e0 opera\u00e7\u00e3o da Cidade.\n<p><b>PROCEDIMENTOS<\/b><\/p>\n<b>Processo de inscri\u00e7\u00e3o<\/b><br \/>\nA Cidade fornecer\u00e1 acomoda\u00e7\u00f5es razo\u00e1veis em todas as etapas do processo de contrata\u00e7\u00e3o.<br \/>\nSolicita-se que os candidatos e funcion\u00e1rios informem o Departamento de Recursos Humanos o mais r\u00e1pido poss\u00edvel caso necessitem de alguma adapta\u00e7\u00e3o no processo de inscri\u00e7\u00e3o, nos testes ou na entrevista.\n<b>Aptid\u00e3o para o trabalho <\/b><br \/>\nDe acordo com as Regras de Pessoal da Cidade, a Cidade pode exigir uma avalia\u00e7\u00e3o m\u00e9dica de aptid\u00e3o para o trabalho para determinar se um funcion\u00e1rio \u00e9 capaz de desempenhar as fun\u00e7\u00f5es essenciais de seu trabalho. Essa avalia\u00e7\u00e3o ser\u00e1 conduzida por especialistas m\u00e9dicos que determinar\u00e3o se a condi\u00e7\u00e3o do funcion\u00e1rio \u00e9 adequada e quais adapta\u00e7\u00f5es razo\u00e1veis, se houver, seriam necess\u00e1rias de acordo com as fun\u00e7\u00f5es essenciais da descri\u00e7\u00e3o do cargo atual.\n<b>Incapacidade Permanente <\/b><br \/>\nUm funcion\u00e1rio que n\u00e3o seja mais capaz de desempenhar as fun\u00e7\u00f5es essenciais do cargo, com ou sem adapta\u00e7\u00f5es razo\u00e1veis, poder\u00e1 ser considerado para outros cargos na Prefeitura para os quais seja qualificado. Se n\u00e3o houver tal cargo, ou se o funcion\u00e1rio se recusar a aceit\u00e1-lo, e n\u00e3o for poss\u00edvel nenhuma adapta\u00e7\u00e3o razo\u00e1vel para mant\u00ea-lo em seu cargo atual ou em qualquer outro, a demiss\u00e3o ser\u00e1 considerada. Isso n\u00e3o depender\u00e1 de qualquer recurso que o funcion\u00e1rio tenha por meio de Benef\u00edcios de Compensa\u00e7\u00e3o Trabalhista ou de aposentadoria por invalidez.
