Qualquer funcion\u00e1rio que seja informado sobre comportamento discriminat\u00f3rio ilegal tem a responsabilidade afirmativa de denunci\u00e1-lo \u00e0 Divis\u00e3o de Rela\u00e7\u00f5es Trabalhistas e de Empregados pelo telefone 305.673.7524.<br \/>\nO Recursos Humanos investigar\u00e1 e analisar\u00e1 as reclama\u00e7\u00f5es, determinar\u00e1 se ocorreu um ato de discrimina\u00e7\u00e3o ilegal e recomendar\u00e1 as medidas cab\u00edveis ao Administrador Municipal ou a pessoa designada. Quando um funcion\u00e1rio reclamar de comportamento discriminat\u00f3rio ilegal e solicitar que nada seja dito ou feito, o gerente ou supervisor informar\u00e1 ao funcion\u00e1rio que ele\/ela tem a responsabilidade de relatar a reclama\u00e7\u00e3o \u00e0 hierarquia superior ou ao Recursos Humanos. As reclama\u00e7\u00f5es ser\u00e3o confidenciais, na medida do poss\u00edvel, mas n\u00e3o poder\u00e3o ser ocultadas das pessoas em posi\u00e7\u00e3o de investigar e tomar medidas corretivas, se apropriado.<br \/>\nGerentes e supervisores ser\u00e3o responsabilizados por sua pronta aten\u00e7\u00e3o e execu\u00e7\u00e3o das a\u00e7\u00f5es preventivas, corretivas e positivas necess\u00e1rias. Funcion\u00e1rios em posi\u00e7\u00e3o de autoridade dever\u00e3o envidar todos os esfor\u00e7os para n\u00e3o tomar nenhuma a\u00e7\u00e3o pessoal adversa contra o reclamante ou tomar qualquer outra a\u00e7\u00e3o que possa ser percebida como retalia\u00e7\u00e3o por qualquer parte.<br \/>\n<strong>PROCEDIMENTO<\/strong>:\n<ul>\n<li>O reclamante (membro do p\u00fablico, funcion\u00e1rio ou requerente) deve entrar em contato com o Departamento de Rela\u00e7\u00f5es Trabalhistas, seu gerente ou supervisor e declarar a natureza de sua reclama\u00e7\u00e3o.<\/li>\n<li>Se a reclama\u00e7\u00e3o for registrada diretamente ao diretor do departamento, o gerente ou supervisor ter\u00e1 10 dias \u00fateis para resolver a reclama\u00e7\u00e3o dentro do departamento e relatar a natureza da reclama\u00e7\u00e3o e as medidas subsequentes ao Departamento de Rela\u00e7\u00f5es Trabalhistas e de Empregados.<\/li>\n<li>A conclus\u00e3o das investiga\u00e7\u00f5es de apura\u00e7\u00e3o de fatos pela Divis\u00e3o de Rela\u00e7\u00f5es Trabalhistas e de Empregados dever\u00e1 ser realizada com celeridade. O Diretor do Departamento, ou seu representante, ser\u00e1 oficialmente informado sobre a natureza da den\u00fancia e o processo de apura\u00e7\u00e3o de fatos. O Diretor do Departamento, o Diretor Adjunto ou o Diretor da Divis\u00e3o participar\u00e1 do processo investigativo, a menos que seja o objeto da den\u00fancia.<\/li>\n<li>O processo investigativo resultar\u00e1 na determina\u00e7\u00e3o de &quot;causa razo\u00e1vel&quot; ou &quot;aus\u00eancia de causa&quot; para crer que ocorreu discrimina\u00e7\u00e3o ilegal. A oportunidade para uma concilia\u00e7\u00e3o informal ser\u00e1 estendida a todas as partes envolvidas.<\/li>\n<li>O Diretor do Departamento de Recursos Humanos dever\u00e1 transmitir as conclus\u00f5es e recomenda\u00e7\u00f5es ao Diretor do Departamento apropriado ou ao Gerente Municipal Assistente, caso o Diretor do Departamento seja o objeto da reclama\u00e7\u00e3o.<\/li>\n<li>Se o assunto n\u00e3o puder ser resolvido de forma satisfat\u00f3ria para todas as partes, o Diretor de Recursos Humanos e\/ou o Diretor Assistente dever\u00e3o buscar orienta\u00e7\u00e3o dos Gerentes Assistentes da Cidade e do Gerente da Cidade apropriados.<\/li>\n<li>O reclamante ser\u00e1 notificado, por escrito, do resultado da investiga\u00e7\u00e3o e ser\u00e1 convidado a se reunir com a Equipe de Rela\u00e7\u00f5es Trabalhistas e de Funcion\u00e1rios para revisar e discutir o conte\u00fado do arquivo.<\/li>\n<li>Embora a Prefeitura de Miami Beach esteja comprometida em resolver den\u00fancias de discrimina\u00e7\u00e3o ilegal internamente, \u00e9 irrealista esperar que todos os reclamantes fiquem satisfeitos com a investiga\u00e7\u00e3o e a resolu\u00e7\u00e3o do caso. Portanto, todos os reclamantes nesses casos devem ser informados sobre seu direito de registrar uma queixa junto a uma ag\u00eancia externa.<\/li>\n<li>Em nenhuma circunst\u00e2ncia o arquivo de reclama\u00e7\u00e3o e investiga\u00e7\u00e3o se tornar\u00e1 parte da pasta pessoal de um funcion\u00e1rio, do arquivo pessoal oficial ou de qualquer arquivo mantido pelo departamento, divis\u00e3o ou supervisor.<\/li>\n<li>Coment\u00e1rios sobre a reclama\u00e7\u00e3o n\u00e3o ser\u00e3o inclu\u00eddos na avalia\u00e7\u00e3o de desempenho de nenhum reclamante.<\/li>\n<\/ul>\n<p>O reclamante
