Como parte de seus esfor\u00e7os cont\u00ednuos de gest\u00e3o da diversidade, em conformidade com as diretrizes sobre discrimina\u00e7\u00e3o sexual emitidas pela Comiss\u00e3o de Igualdade de Oportunidades de Emprego, a Cidade de Miami Beach apoia integralmente a legisla\u00e7\u00e3o que visa proteger e salvaguardar os direitos e as oportunidades de todas as pessoas de buscar, obter e manter emprego sem serem v\u00edtimas de ass\u00e9dio sexual. A pol\u00edtica da Cidade de Miami Beach \u00e9 proporcionar um ambiente livre de ass\u00e9dio sexual.\n<b>Conscientiza\u00e7\u00e3o sobre ass\u00e9dio sexual <\/b><br \/>\nAss\u00e9dio sexual \u00e9 uma viola\u00e7\u00e3o do T\u00edtulo VII da Lei dos Direitos Civis de 1964. Como tal, cada funcion\u00e1rio da cidade de Miami Beach, homem ou mulher, como condi\u00e7\u00e3o de emprego e de acordo com as pol\u00edticas da cidade, se compromete a manter e afirmar tal Pol\u00edtica de Ass\u00e9dio que a cidade adotou e, ao se comprometer, concorda em: n\u00e3o fazer avan\u00e7os sexuais indesejados ou solicita\u00e7\u00f5es de favores sexuais ou outra conduta verbal ou f\u00edsica de natureza sexual uma condi\u00e7\u00e3o de emprego de qualquer funcion\u00e1rio; n\u00e3o tomar decis\u00f5es de emprego com base na submiss\u00e3o ou rejei\u00e7\u00e3o de tal conduta; e n\u00e3o criar um ambiente de trabalho intimidador, hostil ou ofensivo por meio de tal conduta.\n<b>Defini\u00e7\u00f5es<\/b><br \/>\nAss\u00e9dio sexual refere-se a comportamentos pessoalmente ofensivos, que desrespeitam os direitos dos outros, diminuem o moral e, portanto, interferem na efic\u00e1cia do trabalho. O ass\u00e9dio sexual pode ser evidente ou sutil. Por defini\u00e7\u00e3o, o ass\u00e9dio sexual \u00e9 um insulto e uma humilha\u00e7\u00e3o para quem o recebe e n\u00e3o pode ser tolerado no local de trabalho. Uma v\u00edtima de ass\u00e9dio sexual n\u00e3o precisa ser a pessoa assediada; inclui qualquer pessoa afetada pela conduta ofensiva. O ass\u00e9dio sexual \u00e9 uma conduta indesejada de natureza sexual e pode consistir em investidas sexuais, pedidos de favores sexuais e outras condutas verbais ou f\u00edsicas. A conduta pode constituir ass\u00e9dio sexual quando afeta, expl\u00edcita ou implicitamente, o emprego de um indiv\u00edduo, interfere injustificadamente no desempenho profissional de um indiv\u00edduo ou cria um ambiente de trabalho intimidador, hostil ou ofensivo. O supervisor da v\u00edtima, um agente do empregador, um supervisor em outra \u00e1rea, um colega de trabalho ou um n\u00e3o funcion\u00e1rio pode ser um assediador sexual.\n<p>Em cada caso, a v\u00edtima decide se o comportamento \u00e9 bem-vindo ou n\u00e3o. O que importa \u00e9 o impacto do comportamento na v\u00edtima, n\u00e3o a inten\u00e7\u00e3o do assediador. Todas as den\u00fancias apresentadas \u00e0 Divis\u00e3o de Rela\u00e7\u00f5es Trabalhistas e Empregat\u00edcias do Departamento de Recursos Humanos s\u00e3o levadas a s\u00e9rio. Cada caso \u00e9 analisado quanto \u00e0 sufici\u00eancia e investigado com base em seu m\u00e9rito. O sexo do reclamante n\u00e3o tem influ\u00eancia na den\u00fancia. Com os avan\u00e7os tecnol\u00f3gicos, o ass\u00e9dio sexual agora inclui <em>\u201cAss\u00e9dio Textual\u201d<\/em> que \u00e9 \u201cenviar mensagens de texto\u201d ofensivas ou outras mensagens inapropriadas, e <em>\u201cSexting\u201d<\/em> que envolve o envio de mensagens sexualmente expl\u00edcitas e tamb\u00e9m inclui, mas n\u00e3o se limita a, fotografias ou outros materiais pornogr\u00e1ficos e piadas.<\/p>\n<p>O ass\u00e9dio sexual pode assumir diferentes formas, incluindo:<\/p>\n<ul>\n<li><em>Verbal:<\/em>\u00a0 Insinua\u00e7\u00f5es, coment\u00e1rios sugestivos, piadas de cunho sexual, propostas sexuais, amea\u00e7as.<\/li>\n<li><em>N\u00e3o verbal:\u00a0<\/em>Objetos ou imagens sexualmente sugestivos, coment\u00e1rios gr\u00e1ficos, sons sugestivos ou insultuosos, olhares maliciosos, assobios, gestos obscenos.<\/li>\n<li><em>F\u00edsico:<\/em>\u00a0\u00a0 Contato f\u00edsico indesejado, incluindo tocar, beliscar, ro\u00e7ar o corpo, agress\u00e3o sexual.<\/li>\n<\/ul>\n<p>Cada funcion\u00e1rio da ger\u00eancia, incluindo supervisores de primeira linha, \u00e9 respons\u00e1vel por manter um ambiente de trabalho livre de ass\u00e9dio sexual. Essa responsabilidade inclui, entre outras, lembrar os funcion\u00e1rios sob sua supervis\u00e3o da pol\u00edtica da Prefeitura contra a pr\u00e1tica de ass\u00e9dio sexual. Quando um gerente ou supervisor toma conhecimento de um incidente de ass\u00e9dio sexual, \u00e9 sua responsabilidade informar Lana Hernandez, da Divis\u00e3o de Rela\u00e7\u00f5es Trabalhistas e de Empregados do Departamento de Recursos Humanos, se o indiv\u00edduo afetado deseja que sua situa\u00e7\u00e3o seja denunciada ou se n\u00e3o deseja buscar medidas corretivas. A Sra. Hernandez pode ser contatada pelo telefone 305.673.7524.<\/p>\nDada a gravidade deste tipo de discrimina\u00e7\u00e3o, a Cidade reconhece que acusa\u00e7\u00f5es inv\u00e1lidas, infundadas ou falsas de ass\u00e9dio sexual podem ter efeitos graves e prejudiciais a indiv\u00edduos inocentes. Se a den\u00fancia<br \/>\nfor considerada falsa e uma deturpa\u00e7\u00e3o deliberada dos fatos, feita com inten\u00e7\u00e3o maliciosa, a parte que apresentou a den\u00fancia falsa estar\u00e1 sujeita a medidas disciplinares. Medidas disciplinares apropriadas tamb\u00e9m ser\u00e3o tomadas contra qualquer funcion\u00e1rio que violar esta pol\u00edtica.\n<p><b>PROCEDIMENTOS<\/b><\/p>\n<b>Apresentar uma queixa de ass\u00e9dio sexual<br \/>\n<\/b>Qualquer funcion\u00e1rio que acredite ter sido v\u00edtima de ass\u00e9dio sexual deve relatar o(s) incidente(s) imediatamente ao seu supervisor, ao diretor de departamento ou \u00e0 Sra. Hernandez.\n<p>Se uma reclama\u00e7\u00e3o for contra um Diretor de Departamento, a reclama\u00e7\u00e3o dever\u00e1 ser registrada diretamente com a Sra. Hernandez. As reclama\u00e7\u00f5es ser\u00e3o investigadas de forma confidencial e oportuna. As informa\u00e7\u00f5es relativas a uma reclama\u00e7\u00e3o n\u00e3o ser\u00e3o divulgadas a terceiros ou a qualquer pessoa na Prefeitura que n\u00e3o tenha necessidade de conhec\u00ea-las. O objetivo desta disposi\u00e7\u00e3o \u00e9 proteger a confidencialidade de um funcion\u00e1rio que apresente uma reclama\u00e7\u00e3o, incentiv\u00e1-los a denunciar quaisquer incidentes de ass\u00e9dio sexual e proteger a reputa\u00e7\u00e3o de qualquer funcion\u00e1rio injustamente acusado de ass\u00e9dio sexual.<\/p>\n<p>A investiga\u00e7\u00e3o de den\u00fancias geralmente inclui a confer\u00eancia com as partes envolvidas e quaisquer testemunhas nomeadas ou aparentes. Os funcion\u00e1rios ter\u00e3o a garantia de tratamento imparcial e justo. Todos os funcion\u00e1rios ser\u00e3o protegidos contra coer\u00e7\u00e3o, intimida\u00e7\u00e3o, retalia\u00e7\u00e3o, interfer\u00eancia ou discrimina\u00e7\u00e3o por apresentarem uma den\u00fancia ou auxiliarem em uma investiga\u00e7\u00e3o. Se a investiga\u00e7\u00e3o revelar que a den\u00fancia \u00e9 procedente, ser\u00e3o recomendadas \u00e0 autoridade competente da Prefeitura a pronta aten\u00e7\u00e3o e a aplica\u00e7\u00e3o de
