Os cr\u00e9ditos tribut\u00e1rios proporcionam uma redu\u00e7\u00e3o percentual do imposto de renda devido. O cr\u00e9dito tribut\u00e1rio para reabilita\u00e7\u00e3o 20% equivale a 20% do valor gasto na reabilita\u00e7\u00e3o de um edif\u00edcio hist\u00f3rico certificado. O objetivo do cr\u00e9dito para reabilita\u00e7\u00e3o \u00e9 recolocar o edif\u00edcio em uso para que ele seja funcional e atenda \u00e0s necessidades atuais de habita\u00e7\u00e3o, varejo, com\u00e9rcio ou ind\u00fastria.<\/p>\n<p>Todos os elementos de um projeto de reabilita\u00e7\u00e3o devem atender aos Padr\u00f5es de Reabilita\u00e7\u00e3o do Secret\u00e1rio do Interior. Tamb\u00e9m devem atender aos requisitos tribut\u00e1rios b\u00e1sicos do C\u00f3digo da Receita Federal. O cr\u00e9dito tribut\u00e1rio deve ser reivindicado no formul\u00e1rio apropriado do IRS para o ano fiscal em que o edif\u00edcio reabilitado entrar em servi\u00e7o.<\/p>\n<p>Servid\u00f5es de Preserva\u00e7\u00e3o permitem dedu\u00e7\u00f5es do imposto de renda federal para contribui\u00e7\u00f5es beneficentes de interesses parciais em propriedades hist\u00f3ricas. Uma servid\u00e3o de preserva\u00e7\u00e3o \u00e9 um acordo legal volunt\u00e1rio entre o propriet\u00e1rio de um im\u00f3vel (o outorgante) e uma ag\u00eancia governamental ou organiza\u00e7\u00e3o de preserva\u00e7\u00e3o (o benefici\u00e1rio). A servid\u00e3o protege um recurso hist\u00f3rico, arqueol\u00f3gico ou cultural significativo perpetuamente, em benef\u00edcio das gera\u00e7\u00f5es futuras.<\/p>\n<p>A servid\u00e3o pode ser \u00fanica para cada propriedade e incorporar diversos elementos. Os elementos protegidos podem incluir a fachada, o interior, o terreno, mirantes, direitos a\u00e9reos, etc. A servid\u00e3o de fachada \u00e9 o tipo de doa\u00e7\u00e3o mais pr\u00e1tico e comum. Os termos do acordo s\u00e3o firmados por consentimento m\u00fatuo entre o propriet\u00e1rio do im\u00f3vel e a organiza\u00e7\u00e3o detentora da servid\u00e3o.<\/p>\n<p>Uma servid\u00e3o permite que o doador mantenha a propriedade privada e o uso de um im\u00f3vel e, se determinados crit\u00e9rios forem atendidos, solicite uma dedu\u00e7\u00e3o do imposto de renda federal equivalente ao valor dos direitos doados. As condi\u00e7\u00f5es de preserva\u00e7\u00e3o permanente devem ser acordadas e cumpridas para que o propriet\u00e1rio solicite a dedu\u00e7\u00e3o fiscal. Al\u00e9m disso, o p\u00fablico deve ter algum acesso visual ao im\u00f3vel doado. A servid\u00e3o \u00e9 vinculativa para o propriet\u00e1rio que a concede, bem como para todos os propriet\u00e1rios subsequentes. O propriet\u00e1rio pode vender ou legar o im\u00f3vel a quem desejar.<\/p>\n<p>Detalhes sobre o Cr\u00e9dito Tribut\u00e1rio 20% ou Servid\u00f5es de Preserva\u00e7\u00e3o podem ser obtidos no Servi\u00e7o Nacional de Parques e no Servi\u00e7o de Receita Federal, <a href=\"https:\/\/www.nps.gov\/index.htm\"><strong>www.nps.gov<\/strong><\/a> \/ 202.354.2055; ou o Oficial de Preserva\u00e7\u00e3o Hist\u00f3rica do Estado, 850.245.6300.<\/p>\n<p><strong><a href=\"http:\/\/www.miamidade.gov\/planning\/historic-preservation.asp\">Incentivos locais de preserva\u00e7\u00e3o hist\u00f3rica<\/a><\/strong><\/p>\n<p>Al\u00e9m da Zona Empresarial, melhorias em propriedades hist\u00f3ricas podem se qualificar para o incentivo de preserva\u00e7\u00e3o hist\u00f3rica do Condado de Miami-Dade, que oferece um desconto de 10 anos nos impostos sobre a propriedade das melhorias.<\/p>\n<p>O Condado de Miami Dade oferece a isen\u00e7\u00e3o do imposto predial ad valorem, que isenta 100% do valor tribut\u00e1vel de todas as benfeitorias qualificadas em propriedades hist\u00f3ricas por um per\u00edodo de 10 anos. Essa isen\u00e7\u00e3o se aplica apenas aos impostos prediais do condado, n\u00e3o aos impostos prediais municipais. A legisla\u00e7\u00e3o do Condado de Miami Dade funciona &quot;congelando&quot; o valor tribut\u00e1vel \u00e0 al\u00edquota em que foram tributados antes da realiza\u00e7\u00e3o das benfeitorias. Em outras palavras, o valor incremental adicionado pelas benfeitorias autorizadas n\u00e3o \u00e9 adicionado \u00e0 avalia\u00e7\u00e3o.<\/p>\n<p>Para reivindicar este benef\u00edcio, o propriet\u00e1rio deve apresentar um requerimento ao Conselho de Preserva\u00e7\u00e3o Hist\u00f3rica de Miami Beach, que o encaminha, juntamente com sua recomenda\u00e7\u00e3o, ao Escrit\u00f3rio de Preserva\u00e7\u00e3o Hist\u00f3rica do Condado de Miami-Dade para posterior processamento. Ap\u00f3s a aprova\u00e7\u00e3o, o propriet\u00e1rio firma um acordo com a Comiss\u00e3o do Condado relativo \u00e0 manuten\u00e7\u00e3o e prote\u00e7\u00e3o do im\u00f3vel por um per\u00edodo de dez anos, com in\u00edcio em 1\u00ba de janeiro, ap\u00f3s a conclus\u00e3o das melhorias. Muitos im\u00f3veis hist\u00f3ricos em South Beach j\u00e1 receberam este benef\u00edcio. Esse m\u00e9todo alternativo permite que o im\u00f3vel seja avaliado com base no uso real, em vez do uso m\u00e1ximo e ideal, o que pode reduzir os impostos prediais. Para ser eleg\u00edvel, o im\u00f3vel deve ser oficialmente designado como hist\u00f3rico por decreto local ou listado no Registro Nacional de Lugares Hist\u00f3ricos. Tamb\u00e9m deve ser de natureza comercial (pr\u00e9dios de apartamentos n\u00e3o est\u00e3o inclu\u00eddos) e estar aberto ao p\u00fablico por pelo menos 40 horas semanais, durante 45 semanas por ano, ou o equivalente a 1.800 horas por ano. O benef\u00edcio se aplica apenas \u00e0 parcela do imposto referente ao Condado de Miami-Dade.<\/p>\n<p>Para solicitar este benef\u00edcio, os propriet\u00e1rios de im\u00f3veis qualificados devem apresentar um requerimento ao Departamento de Avalia\u00e7\u00e3o de Im\u00f3veis do Condado de Miami-Dade at\u00e9 1\u00ba de mar\u00e7o de cada ano.
