Noise Control Rules for Construction and Equipment Use

The City of Miami Beach enforces specific regulations to manage construction noise, equipment use, and public right-of-way activity. These rules help protect community quality of life, ensure safety, and maintain accessibility—especially during holidays and major events. Please review each section carefully to ensure full compliance with city code.

Construction Noise Hours

Sec. 46-156(2) Construction
Construction work that causes noise beyond the allowed limits (even when using properly maintained and quiet equipment) is only allowed during the following hours:

1. Commercial, Industrial, and Mixed-Use Zones

(Areas zoned CCC, GU, I-1, MR, CPS-1, CPS-2, CPS-3, CPS-4, RO, WD-1, WD-2, GC, HD, MXE, CD-1, CD-2 and CD-3.)

  • Allowed Hours:
    • 7:30 a.m. – 6:30 p.m. (Standard Time)
    • 7:30 a.m. – 7:30 p.m. (Daylight Saving Time)
  • No construction noise is allowed on Sundays or national holidays.

2. Residential Zones

(Areas zoned RM-1, RM-2, RM-3, RM-PRD, RPS-1, RPS-2, RPS-3, RPS-4, RMPS-1, RS-1, RS-2, RS-3, RS-4, RO, TH and in any exclusively residential zoning district not otherwise specified in this subsection and within 300 feet of any of these zoning districts.)

  • Allowed Hours:
    • Weekdays: 8:00 a.m. – 6:00 p.m.
    • Saturdays: 10:00 a.m. – 4:00 p.m.
  • No construction noise is allowed on Sundays or national holidays.

Power Tools &
Landscaping Equipment

Sec. 46-152(k) Power tools and landscaping equipment
The following equipment cannot be used outdoors during the following hours:

  • Lawn mowers, edgers, weed trimmers, leaf blowers, chippers, chainsaws, power tools, and any other noise-producing equipment.

Restricted Hours:

  • Weekdays: 8:00 p.m. – 8:00 a.m.
  • Weekends & Holidays: 8:00 p.m. – 10:00 a.m.

Golf Courses

Stricter limits apply:

  • No noise-producing equipment between 8:00 p.m. and 5:30 a.m. on any day (weekdays, weekends, and holidays).

Exceptions for Single-Family Homes

The weekend and holiday restrictions do not apply to single-family homes in the following zoning districts:
RS-1, RS-2, RS-3, RS-4, RM-1, RM-2, RM-PRD, RM-PRD-2, RO, RO-2, RO-3, and TH (Townhouse)

This means residents in these zones can use power tools and landscaping equipment on weekends and holidays outside the restricted hours.

Additionally, the use of gas-powered leaf blowers and gas-powered chainsaws is prohibited within the city. However, large, gas-powered chainsaws can be used if their use is required to accomplish a task for which smaller sized battery- or electric-powered chainsaws are not suitable.

Please note: Gas-powered leaf blowers and chainsaws are prohibited in Miami Beach per ordinance 2024-4589. Fines for violations start at $250 for the first violation followed by $500 for the second violation and $1,000 for subsequent violations. Penalties

Sec. 46-159 Fines and penalties for violations
Any violations observed shall be subject to the following code enforcement procedure(s):

  • Issuance of oral warning and/or written warning and notice of violation.
  • Violations may also result in the issuance of the following civil fines and penalties:

4th $4,000 No live or amplified sound allowed for 1 weekend (from Noon Friday to Noon Monday)
5th $5,000 No live or amplified sound allowed for 2 weekends

& Special Events

Federal Holidays where construction noise is not permitted:

  • New Year's Day (January 1)
  • Birthday of Martin Luther King, Jr. (Third Monday in January)
  • Washington's Birthday (Third Monday in February)
  • Memorial Day (Last Monday in May)
  • Juneteenth National Independence Day (June 19)
  • Independence Day (July 4)
  • Labor Day (First Monday in September)
  • Columbus Day (Second Monday in October)
  • Veterans Day (November 11)
  • Thanksgiving Day (Fourth Thursday in November)
  • Christmas Day (December 25)

Citywide Suspension of All Construction Related Activities Within the Public Right-Of-Way

To provide the public with an experience free of impacts from roadway, sidewalk, and lane closures, the City of Miami Beach Public Works Department is implementing a construction moratorium during the following holidays and special events:

  • The Miami Boat Show Week : Monday February, 9 , 2026 – Sunday, February 15 , 2026
  • Memorial Day Weekend : Thursday, May 21 , 2026 – Sunday, May 24 , 2026
  • Independence Day Weekend : Thursday, July 2 ,2026 – Sunday, July 5, 2026
  • Thanksgiving : Monday, November, 23, 2026 – Sunday, November 29, 2026
  • Art Week : Monday, November 30, 2026 – Sunday, December 6, 2026
  • Holiday Break : Monday, December 21, 2026 – Sunday, January 3, 2027

During these periods:

  • All construction-related activities within the public right-of-way are suspended.
  • No lane closures, sidewalk closures, road closures, or construction activity will be permitted in the public right-of-way, except for City Projects.

Contractor Requirements:

  • Remove all barricades, equipment, and stored materials from the right-of-way.
  • Keep the right-of-way free from dust and loose material.
  • Fully restore all trenches and excavations.
  • Maintain containers and plastic jersey barriers free from standing water.

Enforcement & Permitting:

  • These restrictions apply to new permit requests and active construction permits.
  • Enforcement is at the discretion of the Public Works Director.
  • Violators may face fines, restrictions on future permitting, and/or suspension of ROW permits.
