A vehicle may be towed for various reasons. Here’s what you need to know, including your rights and responsibilities, as well as any potential fines you may face.

Types of tows

Public Property Tows

A public property tow occurs when a vehicle is illegally parked on a city street, lot or public right-of-way with a citation issued for a violation. Common reasons for towing include, but are not limited to, parking in fire lanes, fire hydrant zones, crosswalks, sidewalks, bicycle lanes, restricted residential areas, parking spaces designated for disabled persons or other purposes, being double-parked or blocking driveways or other vehicles. To appeal a citation, follow the instructions on the back of the parking ticket. The City of Miami Beach also offers an online appeal process at miamibeachfl.gov/city-hall/parking.

Retrieving Your Vehicle

Only the vehicle owner or authorized agent can retrieve their vehicle and/or be permitted to gain access to the vehicle to remove any personal belongings, after providing one form of photo ID with the name and address matching the vehicle registration or title per Florida Statute 713.78(10), unless the vehicle is a rental. Renters must provide a written rental agreement to act as an agent for the rental company. Renters must also provide either a non-notarized or notarized letter from the rental company listing renter as an agent. Personal property can be retrieved with a valid rental agreement. No vehicle will be released without proper documentation as required by Florida Statute 713.78(17).

Miami Beach Resident Tow Rates

Miami Beach residents are eligible for a discounted tow rate of $150. Storage rates will only apply after the first 24 hours and the Administrative Fee will be waived. To be eligible, the following documents must be provided:

Driver’s license and vehicle registration (which must match a valid Miami Beach address).
Vehicle must be registered in the owner’s name (this requirement does not apply to rental vehicles).
If in transition, a fully executed and effective lease agreement for a Miami Beach property signed in the name of the registered owner of the vehicle and prior to the date of the tow.

Payment Options

ATMs are available at both towing facilities. Accepted payment methods include cash, cashier’s check, money order and traveler’s check. Miami Beach residents can also pay with a credit/debit card and Miami Dade County residents can use a debit card. These payment options apply to public property tows only. Credit/debit cards must match the registered owner’s or agent’s name. Electronic payment options are also available at the towing facilities.

The Miami Beach Towing Bill of Rights must be posted in the towing companies’ customer service area, attached to the tow receipt and displayed on all tow trucks. Please request a copy of the Miami Beach Towing Bill of Rights if not provided with your receipt.
